80-5-605. Venue. If a contract between a grower and a claimant of an intellectual property right violation is silent with regard to venue for any legal proceedings regarding intellectual property rights, venue must be in the district court for the district in which the alleged intellectual property right violation occurred.
Terms Used In Montana Code 80-5-605
- Contract: A legal written agreement that becomes binding when signed.
- Grower: means the person responsible for planting and managing a crop on land where infringement of an intellectual property right is suspected to have occurred. See Montana Code 80-5-602
- Property: means real and personal property. See Montana Code 1-1-205
- Venue: The geographical location in which a case is tried.
