(a) The commission may authorize a civil action for temporary or preliminary relief pending the final disposition of a complaint if the commission concludes after the filing of the complaint that prompt judicial action is necessary to carry out the purposes of this chapter.
(b) On receipt of the commission’s authorization, the attorney general shall promptly file the action.
Terms Used In Texas Property Code 301.086
- Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
- Temporary restraining order: Prohibits a person from an action that is likely to cause irreparable harm. This differs from an injunction in that it may be granted immediately, without notice to the opposing party, and without a hearing. It is intended to last only until a hearing can be held.
(c) A temporary restraining order or other order granting preliminary or temporary relief under this section is governed by the applicable Texas Rules of Civil Procedure.
(d) The filing of a civil action under this section does not affect the initiation or continuation of administrative proceedings under § 301.111.
