Delaware
means an entity, other than a licensed hospital, that provides care, supportive lodging or treatment to individuals with a mental condition Delaware Code Title 16 Sec. 5181
Florida
means a state-owned, state-operated, or state-supported hospital, center, or clinic designated by the department for extended treatment and hospitalization, beyond that provided for by a receiving facility, of persons who have a mental illness, including facilities of the United States Government, and any private facility designated by the department when rendering such services to a person pursuant to the provisions of this part Florida Statutes 394.455
Idaho
means a facility or program meeting applicable licensing standards that has been approved for the provisions of services under this chapter by the department of health and welfare Idaho Code 16-2403
Kansas
means any public or private facility or institution providing inpatient mental health, drug or alcohol treatment or counseling, but does not include a hospital, as defined in Kan Kansas Statutes 22-4902
means the same as defined in Kan Kansas Statutes 65-4024a
Kentucky
means an institution or part thereof, approved by the Cabinet for Health and Family Services, which provides evaluation, care, and treatment for insane or mentally ill persons or individuals with an intellectual disability on an inpatient or outpatient basis, or both Kentucky Statutes 504.060
Louisiana
includes but is not limited to the following, and shall be selected with consideration of first, medical suitability; second, least restriction of the person’s liberty; third, nearness to the patient’s usual residence; fourth, financial or other status of the patient; and fifth, patient’s expressed preference, except that such considerations shall not apply to forensic facilities:

            (i) Public and private behavioral health services providers licensed pursuant to La Louisiana Revised Statutes 28:2

means any public or private hospital, retreat, institution, mental health center, or facility licensed by the state of Louisiana in which any mentally ill minor or minor suffering from substance abuse is received or detained as a patient except a facility under the control or supervision of the Department of Public Safety and Corrections unless otherwise provided in Title VIII of this Code Louisiana Children’s Code 1404
Michigan
means a facility or part of a facility at which liquid industrial by-product undergoes treatment Michigan Laws 324.12102
Nebraska
means a facility which is licensed to provide services for persons who are mentally ill or substance dependent or both Nebraska Statutes 71-914
New York
means a facility designated by the commissioner which may only include a general hospital as defined in Article 28 of the public health law, or a medically managed or medically supervised withdrawal, inpatient rehabilitation, or residential stabilization treatment program that has been certified by the commissioner to have appropriate medical staff available on-site at all times to provide emergency services and continued evaluation of capacity of individuals retained under this section or a crisis stabilization center licensed pursuant to article 36 N.Y. Mental Hygiene Law 22.09
Texas
means any plant, disposal field, lagoon, incinerator, area devoted to sanitary landfills, or other facility installed for the purpose of treating, neutralizing, or stabilizing waste Texas Water Code 26.001
Wisconsin
means any publicly or privately operated facility or unit thereof providing treatment of alcoholic, drug dependent, mentally ill or developmentally disabled persons, including but not limited to inpatient and outpatient treatment programs, community support programs and rehabilitation programs Wisconsin Statutes 51.01
