Under the Alabama Code, punishments for crimes depend on the classification. In the case of this section:

Terms Used In Alabama Code 45-42-150.11

  • Conviction: A judgement of guilt against a criminal defendant.
  • person: includes a corporation as well as a natural person. See Alabama Code 1-1-1

Any person who violates this article shall be guilty of a Class C misdemeanor upon first conviction under this article. Any subsequent conviction shall be a Class A misdemeanor.
