Every person engaged in the business of making bail bonds in Madison County, Alabama, in addition to the twenty-five thousand dollar ($25,000) surety requirement of Section 15-13-22, shall be required to furnish a bond with corporate surety in an amount to be set by the Clerk of the Circuit Court of Madison County. The circuit clerk shall use the following criteria in determining the amount of bond required:

(1) The monetary total of all bonds issued by the bondsman which are outstanding as of July 1 of each year.

  • Bail: Security given for the release of a criminal defendant or witness from legal custody (usually in the form of money) to secure his/her appearance on the day and time appointed.
  • circuit: means judicial circuit. See Alabama Code 1-1-1
  • following: means next after. See Alabama Code 1-1-1
  • person: includes a corporation as well as a natural person. See Alabama Code 1-1-1
  • year: means a calendar year; but, whenever the word "year" is used in reference to any appropriations for the payment of money out of the treasury, it shall mean fiscal year. See Alabama Code 1-1-1
(2) The monetary total of all unpaid final judgments rendered against the bondsman during that year.
(3) The general cooperation exhibited by the bondsman in his or her relations with judges, the district attorney, the circuit clerk, and other court-related officers and employers.
