(a) The Sheriff of Marion County may operate a jail canteen for the benefit of prisoners in county custody. The sheriff shall be responsible for the operation of the canteen.

Terms Used In Alabama Code 45-47-232

  • circuit: means judicial circuit. See Alabama Code 1-1-1
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • year: means a calendar year; but, whenever the word "year" is used in reference to any appropriations for the payment of money out of the treasury, it shall mean fiscal year. See Alabama Code 1-1-1
(b) The sheriff may retain the profits derived from the pay telephones, vending machines, and canteen located in the county jail in a special fund known as the law enforcement fund which shall be used by the sheriff for law enforcement purposes in the county. The fund shall be managed exclusively by the sheriff.
(c) The sheriff shall prepare an annual report detailing expenditures made during each fiscal year from the law enforcement fund. A copy of the report shall be filed no later than 60 days after the close of each fiscal year with the county commission, the presiding judge of the circuit court of the county, and the county district attorney.
(d) Any actions relating to the operation of pay telephones, vending machines, or a canteen in the county jail before June 20, 1995, are ratified and confirmed. Any existing profits derived from the operation of pay telephones, vending machines, or a canteen, or any combination of these services, in the county jail before June 20, 1995, shall be deposited into the law enforcement fund created by this section.
