(a) The sale of alcoholic beverages during certain hours after 12:00 p.m. on Sundays is authorized within the City of Decatur in Morgan County. The Decatur City Council, by ordinance, may regulate and permit the sale of alcoholic beverages after 12:00 p.m. on Sunday by properly licensed retail licensees of the Alcoholic Beverage Control Board.

(b) The Decatur City Council shall hold a referendum to determine if alcoholic beverages may be sold on Sunday. If a majority of the voters voting thereon vote in favor of the question, then the sale of alcoholic beverages after 12:00 p.m. on Sunday shall be authorized.
(c) The referendum shall be held at a special election called for that purpose by the Decatur City Council. Costs of the referendum shall be paid by the City of Decatur. A second or subsequent referendum shall not be held within 12 months following a referendum.
(d) In the event a referendum is called pursuant to this section, the City of Decatur shall conduct a public hearing not less than 10 days before the referendum date in which the content of the proposed ordinance providing for the sale of alcoholic beverages on Sunday pursuant to any resolution of the governing body shall be presented as to the times and locations and other restrictions pertaining to alcoholic beverages sold on Sunday.
