Terms Used In Alabama Code > Title 41 > Chapter 5

  • ADOPTION SUBSIDY: A money payment, services, deferred payment, or any combination thereof that is provided to a child with special needs or circumstances after submission of an application to the department. See Alabama Code 26-10-22
  • agency: The department or a child welfare agency which is authorized in its license issued by the department to place children for adoption. See Alabama Code 26-10-22
  • Allegation: something that someone says happened.
  • application: The submission to the department of a complete application as defined by the department with documentation of the child's special needs. See Alabama Code 26-10-22
  • child: An individual under 19 years of age, or an individual 19 or 20 years of age and eligible for Title IV-E Federal Funding, who is:

  • child: A person under 18 years of age. See Alabama Code 26-16-2
  • CHILD ABUSE: Harm or threatened harm to a child's health or welfare by a person responsible for the child's health or welfare, which harm occurs or is threatened through nonaccidental physical or mental injury; sexual abuse, which includes a violation of any provision of Article 4, Chapter 6, Title 13A. See Alabama Code 26-16-2
  • circuit: means judicial circuit. See Alabama Code 30-3D-608
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • department: The Department of Human Resources. See Alabama Code 26-10-22
  • department: The Department of Child Abuse and Neglect Prevention. See Alabama Code 26-16-2
  • Docket: A log containing brief entries of court proceedings.
  • EMOTIONAL TIES: Includes all of the following:

  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Grand jury: agreement providing that a lender will delay exercising its rights (in the case of a mortgage,
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Impeachment: (1) The process of calling something into question, as in "impeaching the testimony of a witness." (2) The constitutional process whereby the House of Representatives may "impeach" (accuse of misconduct) high officers of the federal government for trial in the Senate.
  • LOCAL COUNCIL: An organization which meets the criteria described in Section 26-16-10. See Alabama Code 26-16-2
  • MENTAL DISABILITY: A condition which is characterized by impaired intellectual development and impedes the ability to function independently as diagnosed by a licensed medical doctor or qualified mental health professional. See Alabama Code 26-10-22
  • neglect: Harm to a child's health or welfare by a person responsible for the child's health or welfare which occurs through negligent treatment, including the failure to provide adequate food, clothing, shelter, or medical care. See Alabama Code 26-16-2
  • oath: includes affirmation. See Alabama Code 30-3D-608
  • organization: A nonprofit organization or a public agency which provides or proposes to provide child abuse and neglect prevention, early intervention services, or parent education. See Alabama Code 26-16-2
  • PHYSICAL DISABILITY: One of the following conditions:

    a. See Alabama Code 26-10-22

  • President pro tempore: A constitutionally recognized officer of the Senate who presides over the chamber in the absence of the Vice President. The President Pro Tempore (or, "president for a time") is elected by the Senate and is, by custom, the Senator of the majority party with the longest record of continuous service.
  • Presiding officer: A majority-party Senator who presides over the Senate and is charged with maintaining order and decorum, recognizing Members to speak, and interpreting the Senate's rules, practices and precedents.
  • PREVENTION PROGRAM: A system of direct provision of child abuse and neglect prevention services to a child, parent, or guardian. See Alabama Code 26-16-2
  • Probate: Proving a will
  • STATE BOARD: The State Child Abuse and Neglect Prevention Board created in Section 26-16-3. See Alabama Code 26-16-2
  • Statute: A law passed by a legislature.
  • Subpoena: A command to a witness to appear and give testimony.
  • Testimony: Evidence presented orally by witnesses during trials or before grand juries.
  • TRUST FUND: The Children's Trust Fund established in the State Treasury. See Alabama Code 26-16-2
  • writing: includes typewriting and printing on paper. See Alabama Code 30-3D-608
