Terms Used In Alaska Statutes 16.05.160

  • Arrest: Taking physical custody of a person by lawful authority.
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • peace officer: means
    (A) an officer of the state troopers. See Alaska Statutes 01.10.060
  • person: includes a corporation, company, partnership, firm, association, organization, business trust, or society, as well as a natural person. See Alaska Statutes 01.10.060
  • state: means the State of Alaska unless applied to the different parts of the United States and in the latter case it includes the District of Columbia and the territories. See Alaska Statutes 01.10.060
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.

Each peace officer designated in Alaska Stat. § 16.05.150 shall arrest a person violating a provision of this title except Alaska Stat. Chapter 16.51 and Alaska Stat. Chapter 16.52, or any regulation adopted under this title except Alaska Stat. Chapter 16.51 and Alaska Stat. Chapter 16.52, in the peace officer’s presence or view, and shall take the person for examination or trial before an officer or court of competent jurisdiction unless in the judgment of the peace officer it would be in the state‘s best interest to issue a warning or a citation under Alaska Stat. § 16.05.165.
