(a) A person commits the offense of failure to use headlights if the person operates a motor vehicle without the use of motor vehicle headlights

Terms Used In Alaska Statutes 28.35.191

  • motor vehicle: means a vehicle which is self-propelled except a vehicle moved by human or animal power. See Alaska Statutes 28.90.990
  • person: includes a corporation, company, partnership, firm, association, organization, business trust, or society, as well as a natural person. See Alaska Statutes 01.10.060
  • traffic: means pedestrians, ridden or herded animals, vehicles, and other conveyances either singly or together while using a highway or vehicular way or area that is open to public use for purposes of travel. See Alaska Statutes 28.90.990
  • vehicle: means a device in, upon, or by which a person or property may be transported or drawn upon or immediately over a highway or vehicular way or area. See Alaska Statutes 28.90.990
(1) between one half-hour after sunset and one half-hour before sunrise;
(2) at any other time when, because of insufficient light or other atmospheric conditions, persons or motor vehicles are not clearly discernible at a distance of 1,000 feet; or
(3) on a road that is a designated traffic safety corridor under Alaska Stat. § 19.10.075.
(b) A person operating a motor vehicle may not be required to use motor vehicle headlights except as required in (a) of this section.
(c) Failure to use headlights is an infraction.
