Terms Used In Alaska Statutes 38.04.030

  • director: means the director of the division of lands of the Department of Natural Resources. See Alaska Statutes 38.04.910
  • Fee simple: Absolute title to property with no limitations or restrictions regarding the person who may inherit it.
  • state: means the State of Alaska unless applied to the different parts of the United States and in the latter case it includes the District of Columbia and the territories. See Alaska Statutes 01.10.060

Programs that may be used by the director to make the state‘s land surface available for private use under Alaska Stat. § 38.04.02038.04.055 include sale of whole or partial rights to the fee simple estate, including conveyance of agricultural use rights; leasing; open-to-entry; homesiting; homesteading; permitting for construction and occupation of cabins in isolated locations on land retained in state ownership; and other methods as provided by law. However, agricultural use rights may be conveyed only after consulting with the Board of Agriculture and Conservation.
