(a) Subject to (b) – (d) of this section, a document that meets the requisites for recording under Alaska Stat. § 40.17.030 may be recorded.

Terms Used In Alaska Statutes 40.17.110

  • Contract: A legal written agreement that becomes binding when signed.
  • Power of attorney: A written instrument which authorizes one person to act as another's agent or attorney. The power of attorney may be for a definite, specific act, or it may be general in nature. The terms of the written power of attorney may specify when it will expire. If not, the power of attorney usually expires when the person granting it dies. Source: OCC
  • property: includes real and personal property. See Alaska Statutes 01.10.060
  • Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
(b) If the document to be recorded is a conveyance, power of attorney, contract for the sale or purchase of real property, or option for the purchase of real property, the document must be acknowledged.
(c) If the document to be recorded is a subdivision plat, the document must comply with the requirements of Alaska Stat. Chapter 40.15.
(d) If the document is a declaration under Alaska Stat. Chapter 34.08, it must comply with the requirements of Alaska Stat. § 34.08.090(b).
