(a) Except as otherwise provided in (b) of this section, records obtained by the administrator or filed under this chapter, including a record contained in or filed with a registration statement, application, notice filing, or report are public records and are available for public examination under Alaska Stat. § 40.25.10040.25.295 (Alaska Public Records Act).

Terms Used In Alaska Statutes 45.56.620

  • action: includes any matter or proceeding in a court, civil or criminal. See Alaska Statutes 01.10.060
  • administrator: means the commissioner of commerce, community, and economic development or a designee of the commissioner. See Alaska Statutes 45.56.900
  • filing: means the receipt under this chapter of a record by the administrator or a designee of the administrator. See Alaska Statutes 45.56.900
  • person: means an individual, a corporation, a partnership, a limited liability company, a limited partnership, a limited liability partnership, an association, a joint-stock company, a trust in which the interests of the beneficiaries are evidenced by a security, an unincorporated organization, a government, or a political subdivision of a government. See Alaska Statutes 45.56.900
  • security: means a note. See Alaska Statutes 45.56.900
(b) The following records are not public records under Alaska Stat. § 40.25.10040.25.295 (Alaska Public Records Act) and are not available for public examination under (a) of this section:

(1) a record obtained by the administrator in connection with an audit, examination or inspection under Alaska Stat. § 45.56.420(d) or an investigation under 45.56.680;
(2) a part of a record filed in connection with a registration statement under Alaska Stat. § 45.56.100 and 45.56.170 – 45.56.190 or a record under Alaska Stat. § 45.56.420(d) that contains trade secrets or confidential information if the person filing the registration statement or report has asserted a claim of confidentiality or privilege that is authorized by law;
(3) a record that is not required to be provided to the administrator or filed under this chapter and is provided to the administrator only on the condition that the record may not be subject to public examination or disclosure;
(4) a nonpublic record received from a person specified in Alaska Stat. § 45.56.630(a); and
(5) a social security number, residential address unless used as a business address, and residential telephone number unless used as a business telephone number, contained in a record that is filed.
(c) If disclosure is for the purpose of a civil, administrative, or criminal investigation, action, or proceeding or to a person specified in Alaska Stat. § 45.56.630(a), the administrator may disclose a record obtained in connection with an audit or inspection under Alaska Stat. § 45.56.420(d) or a record obtained in connection with an investigation under Alaska Stat. § 45.56.680.
