Terms Used In Arizona Laws > Title 17 > Chapter 3

  • Action: includes any matter or proceeding in a court, civil or criminal. See Arizona Laws 1-215
  • Affiliate: means an entity that directly or indirectly, through one or more intermediaries, controls, is controlled by or is under common control with the specified entity. See Arizona Laws 6-971
  • Angling: means the taking of fish by one line and not to exceed two hooks, by one line and one artificial lure, which may have attached more than one hook, or by one line and not to exceed two artificial flies or lures. See Arizona Laws 17-101
  • Arrest: Taking physical custody of a person by lawful authority.
  • Bag limit: means the maximum limit, in number or amount, of wildlife that may lawfully be taken by any one person during a specified period of time. See Arizona Laws 17-101
  • Closed season: means the time during which wildlife may not be lawfully taken. See Arizona Laws 17-101
  • Commercial mortgage banker: means a person who engages in the following:

    (a) Originating commercial mortgage loans. See Arizona Laws 6-971

  • Commercial mortgage loan: means a loan that is directly or indirectly secured by a mortgage or deed of trust or any lien interest on commercial property and created with the consent of the owner of the commercial property. See Arizona Laws 6-971
  • Commission: means the Arizona game and fish commission. See Arizona Laws 17-101
  • Conviction: A judgement of guilt against a criminal defendant.
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Department: means the Arizona game and fish department. See Arizona Laws 17-101
  • Device: means any net, trap, snare, salt lick, scaffold, deadfall, pit, explosive, poison or stupefying substance, crossbow, firearm, bow and arrow, or other implement used for taking wildlife. See Arizona Laws 17-101
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Falconry: means the sport of hunting or taking quarry with a trained raptor. See Arizona Laws 17-101
  • Federal deposit insurance corporation: includes any successor to the corporation or other agency or instrumentality of the United States that undertakes to discharge the purposes of the corporation. See Arizona Laws 6-101
  • Felony: A crime carrying a penalty of more than a year in prison.
  • Fishing: means to lure, attract or pursue aquatic wildlife in such a manner that the wildlife may be captured or killed. See Arizona Laws 17-101
  • Fraud: Intentional deception resulting in injury to another.
  • Fur dealer: means any person engaged in the business of buying for resale the raw pelts or furs of wild mammals. See Arizona Laws 17-101
  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Guide: means a person who does any of the following:

    (a) Advertises for guiding services. See Arizona Laws 17-101

  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • License: means a license issued under this article. See Arizona Laws 6-971
  • License year: means the twelve-month period between January 1 and December 31, inclusive, or a different twelve-month period as prescribed by the commission by rule. See Arizona Laws 17-101
  • Licensee: means a person who is licensed under this article. See Arizona Laws 6-971
  • Magistrate: means an officer having power to issue a warrant for the arrest of a person charged with a public offense and includes the chief justice and justices of the supreme court, judges of the superior court, judges of the court of appeals, justices of the peace and judges of a municipal court. See Arizona Laws 1-215
  • Minor: means a person under the age of eighteen years. See Arizona Laws 1-215
  • Misdemeanor: Usually a petty offense, a less serious crime than a felony, punishable by less than a year of confinement.
  • Mortgage: The written agreement pledging property to a creditor as collateral for a loan.
  • Mortgage loan: A loan made by a lender to a borrower for the financing of real property. Source: OCC
  • National credit union administration: includes any successor to the organization or other agency or instrumentality of the United States that undertakes to discharge the purposes of the organization. See Arizona Laws 6-101
  • Open season: means the time during which wildlife may be lawfully taken. See Arizona Laws 17-101
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Peace officers: means sheriffs of counties, constables, marshals, policemen of cities and towns, commissioned personnel of the department of public safety, personnel who are employed by the state department of corrections and the department of juvenile corrections and who have received a certificate from the Arizona peace officer standards and training board, peace officers who are appointed by a multicounty water conservation district and who have received a certificate from the Arizona peace officer standards and training board, police officers who are appointed by community college district governing boards and who have received a certificate from the Arizona peace officer standards and training board, police officers who are appointed by the Arizona board of regents and who have received a certificate from the Arizona peace officer standards and training board, police officers who are appointed by the governing body of a public airport pursuant to section 28-8426 and who have received a certificate from the Arizona peace officer standards and training board, peace officers who are appointed by a private postsecondary institution pursuant to section 15-1897 and who have received a certificate from the Arizona peace officer standards and training board and special agents from the office of the attorney general, or of a county attorney, and who have received a certificate from the Arizona peace officer standards and training board.   • Person: includes a corporation, company, partnership, firm, association or society, as well as a natural person. See Arizona Laws 1-215
  • Possession limit: means the maximum limit, in number or amount of wildlife, that may be possessed at one time by any one person. See Arizona Laws 17-101
  • Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government.
  • Road: means any maintained right-of-way for public conveyance. See Arizona Laws 17-101
  • Statewide: means all lands except those areas lying within the boundaries of state and federal refuges, parks and monuments, unless specifically provided differently by commission order. See Arizona Laws 17-101
  • Superintendent: means the superintendent of financial institutions. See Arizona Laws 6-101
  • Take: means pursuing, shooting, hunting, fishing, trapping, killing, capturing, snaring or netting wildlife or the placing or using of any net or other device or trap in a manner that may result in the capturing or killing of wildlife. See Arizona Laws 17-101
  • Taxidermist: means any person who engages for hire in the mounting, refurbishing, maintaining, restoring or preserving of any display specimen. See Arizona Laws 17-101
  • trapping: means taking wildlife in any manner except with a gun or other implement in hand. See Arizona Laws 17-101
  • Trophy: means :

    (a) A mule deer buck with at least four points on one antler, not including the eye-guard point. See Arizona Laws 17-101

  • Trustee: A person or institution holding and administering property in trust.
  • Verdict: The decision of a petit jury or a judge.
  • Wild: means , in reference to mammals and birds, those species that are normally found in a state of nature. See Arizona Laws 17-101
  • Wildlife: means all wild mammals, wild birds and the nests or eggs thereof, reptiles, amphibians, mollusks, crustaceans and fish, including their eggs or spawn. See Arizona Laws 17-101
