Agency banking services must be authorized under general or specific statutory authority. An agency desiring to procure banking services shall comply with the following:

  • Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
  • Contract: A legal written agreement that becomes binding when signed.
    (1) Prior to development of specifications for the procured service, an agency shall submit in writing to the Chief Financial Officer, that information requested on Form DI4-1090, “”Request for Authorization to Procure Banking Services.”” Supporting documents that are relevant to the request shall be appended. The Chief Financial Officer’s review process shall include evaluation of the request in terms of achieving the most cost effective approach possible. The Chief Financial Officer shall determine whether the procurement method will result in an efficient method of handling financial assets under the control of the Chief Financial Officer or of the various state agencies. In making this determination, the Chief Financial Officer shall consider whether specialized consulting services are necessary, and whether a competitive selection process employing an Invitation to Bid or a Request for Proposal should be used. The Chief Financial Officer will respond to the request within seven working days of the receipt of all required information.
    (2) The Chief Financial Officer’s response shall indicate the level of the Chief Financial Officer’s involvement, including developing the specifications, serving on the evaluation committee, and/or participating in the preparation and execution of a contract.
    (3) Upon receipt of approval, the submitting agency shall designate a staff person to serve as liaison with the Chief Financial Officer in respect to proceeding with the procurement.
    (4) Failure to comply with these provisions will render any resulting contract null and void.
