Terms Used In Florida Statutes 78.08

  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Personal property: All property that is not real property.
  • Writ: A formal written command, issued from the court, requiring the performance of a specific act.
The writ shall command the sheriff to replevy the described personal property in possession of defendant.
