(a) Any records, reports, or information obtained under Ԥ 49106, 49107 and 49108 of this Chapter shall be available to the public, except that upon a showing satisfactory to the Agency by any person that records, reports or information, or particular part thereof, other than emission data, to which the Agency has access under Ԥ 49106, 49107 and 49108 of this Chapter, if made public, would divulge production, sales figures, methods, processes or production unique to the person, or would otherwise tend to effect adversely the competitive position of the person by revealing trade secrets, the Agency shall consider the record, report, information or particular portion thereof, confidential in the administration of this Chapter. The contents of an air pollution control permit itself shall not be entitled to confidentiality protection.

(b) Nothing in the Section shall be construed to prevent the use of records or information by the Agency in compiling or publishing analyses or summaries relating to the general condition of the outdoor atmosphere, provided that these analyses or summaries do not identify any owner or operator or reveal any information otherwise confidential under this Section.

(c) Nothing in this Section shall be construed to prevent disclosure of whatever report, record or information to Federal, Territorial or local representatives as is necessary for purposes of administration of any Federal, Territorial or local air pollution control laws, or when relevant, in any proceeding under this Chapter.
