Terms Used In Hawaii Revised Statutes 21B-2

  • Impeachment: (1) The process of calling something into question, as in "impeaching the testimony of a witness." (2) The constitutional process whereby the House of Representatives may "impeach" (accuse of misconduct) high officers of the federal government for trial in the Senate.
  • Indictment: The formal charge issued by a grand jury stating that there is enough evidence that the defendant committed the crime to justify having a trial; it is used primarily for felonies.
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.

The house of representatives shall have the power of impeachment of the governor or lieutenant governor for malfeasance in office, corruption, dereliction of duty, or other high crimes or misdemeanors. Impeachment shall not extend beyond removal from office and disqualification to hold and enjoy any office of honor, trust, or profit under the State, but the person convicted may be liable and subject to indictment, trial, judgment, and punishment as provided by law.
