(a) To assure that bottled water complies with § 328D-2, the following product monitoring of representative samples derived from the bottled product shall be performed:

Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
(1) For microbiological contaminants specified in § 328D-2, a representative sample from a batch or segment of a continuous production for each type of bottled water produced by the plant shall be analyzed weekly; and(2) For chemical, physical, and radiological contaminants specified in § 328D-2, a representative sample from a batch or segment of continuous product run for each type of bottled drinking water produced by the plant shall be analyzed annually.(b) The required product water sampling shall be performed by qualified personnel and required analysis shall be performed by an approved laboratory.(c) Records of required sampling and analysis shall be maintained at the plant not less than two years and shall be available for official review upon request of the department or government agency or agencies having jurisdiction.
