(a) A claim under this chapter may not be brought against a person more than four years after that person participated in the illegal drug market.

Terms Used In Hawaii Revised Statutes 663E-11

  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Illegal drug: means "dangerous drugs" or a "harmful drug" as defined in section 712-1240. See Hawaii Revised Statutes 663E-1
  • Indictment: The formal charge issued by a grand jury stating that there is enough evidence that the defendant committed the crime to justify having a trial; it is used primarily for felonies.
(b) The limitation period provided for in this chapter is tolled during any time there is a criminal drug offense investigation conducted against the defendant by a governmental agency or there is a criminal drug offense charge, information, or indictment pending against defendant.
