(1) The board may bring any action in the district court for a temporary restraining order, preliminary injunction, or permanent injunction against any person who violates the provisions of this chapter, who falsely holds himself out as a respiratory care practitioner, or who practices or provides respiratory care in violation of this chapter.
(2) Any person who falsely holds himself out as a respiratory care practitioner shall be guilty of using a method, act, or practice that is declared to be unlawful as provided in chapter 6, title 48, Idaho Code.
Terms Used In Idaho Code 54-4313
- Board: means the state board of medicine. See Idaho Code 54-4303
- Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
- person: includes a corporation as well as a natural person;
Idaho Code 73-114Respiratory care: means the treatment, management, diagnostic testing, monitoring, and care of patients with deficiencies and abnormalities associated with the cardiopulmonary system. See Idaho Code 54-4303 Respiratory care practitioner: means a person who has been issued a license or permit by the board under the provisions of this chapter to practice respiratory care under the general supervision of a licensed physician or other authorized licensed health care professional. See Idaho Code 54-4303 Temporary restraining order: Prohibits a person from an action that is likely to cause irreparable harm. This differs from an injunction in that it may be granted immediately, without notice to the opposing party, and without a hearing. It is intended to last only until a hearing can be held.
