Terms Used In Idaho Code > Title 7

  • Abandoned: means the failure of the parent to maintain a normal parental relationship with his child including, but not limited to, reasonable support or regular personal contact. See Idaho Code 30-21-414

  • Case plan hearing: means a hearing to approve, modify or reject the case plan as provided in section 16-1621, Idaho Code. See Idaho Code 30-21-414
  • Catastrophic health benefit plan: means a higher limit health benefit plan developed pursuant to section 41-4712, Idaho Code. See Idaho Code 41-4703
  • Certificate: shall mean the document issued as written evidence of the benefit contract. See Idaho Code 41-3204
  • Certificate of public advantage: means a document issued by the attorney general to parties to a cooperative agreement, verifying that the attorney general declares that the purposes and objectives of the cooperative agreement meet the standards for such agreements set forth by statute.   • Certified family home: means a family-styled living environment in which two (2) or fewer adults live who are not able to reside in their own home and who require care, help in daily living, protection and security, supervision, personal assistance and encouragement toward independence.   • Certified planner: means a person who has completed the nutrient management certification in accordance with the nutrient management standard. See Idaho Code 39-7903
  • CGAD: means a confidential report filed by the insurer or insurance group made in accordance with the requirements of this chapter. See Idaho Code 41-6402
  • Charity: An agency, institution, or organization in existence and operating for the benefit of an indefinite number of persons and conducted for educational, religious, scientific, medical, or other beneficent purposes.
  • Child: means an individual who is under the age of eighteen (18) years. See Idaho Code 30-21-414

  • Circumstances of the child: includes , but is not limited to, the joint legal custody or joint physical custody of the child. See Idaho Code 30-21-414
  • Citizens committee: means the committee named by the council consisting of members of the public. See Idaho Code 39-6602
  • Citizens committee: means the committee consisting of members of the public created pursuant to section 39-6704, Idaho Code, by an air quality council established under the provisions of this chapter. See Idaho Code 39-6705
  • City: means the city where the waste tire storage site is located. See Idaho Code 39-6501
  • Civil forfeiture: The loss of ownership of property used to conduct illegal activity.
  • Claim: means any claim by or on behalf of a natural person as well as any derivative or other claim arising therefrom asserted by or on behalf of any other person. See Idaho Code 39-8704
  • Class of business: means all or a separate grouping of small employers established pursuant to section 41-4705, Idaho Code. See Idaho Code 41-4703
  • Clearing house: means an association of banks or other payors regularly clearing items;

  • Clerk of court: An officer appointed by the court to work with the chief judge in overseeing the court's administration, especially to assist in managing the flow of cases through the court and to maintain court records.
  • Client: means any person who receives financial aid and/or services from an organized program of the department. See Idaho Code 39-3502

  • Commercial hazardous waste facility or site: means any hazardous waste facility whose primary business is the treatment, storage or disposal, for a fee or other consideration, of hazardous waste generated offsite by generators other than the owner and operator of the facility.   • Commercial registered agent: means a person listed under section 30-21-405, Idaho Code. See Idaho Code 30-21-102
  • Commercial solid waste: means all types of solid waste generated by stores, offices, restaurants, warehouses and other nonmanufacturing activities, excluding residential and industrial wastes. See Idaho Code 39-7403
  • Commercial solid waste facility: means a facility owned and operated as an enterprise conducted with the intent of making a profit by any individual, association, firm, or partnership for the disposal of solid waste, but excludes a facility owned or operated by a political subdivision, state or federal agency, municipality or a facility owned or operated by any individual, association, firm or partnership exclusively for the disposal of solid waste generated by such individual, association, firm or partnership.   • Commissary: means a place where food, containers or supplies are stored, prepared or packaged for transit, sale or service at other locations. See Idaho Code 39-1602
  • commission: means the entity organized by the authority of this chapter and agreements, compacts, reciprocal legislation or resolutions with or by the United States of America, the Coeur d’Alene tribe or the state of Washington to implement the basin project. See Idaho Code 39-8103
  • Commission: means the Idaho forest products commission created by section 38-1503, Idaho Code. See Idaho Code 38-1502
  • Commissioner: means a member of the board of commissioners of the basin environmental improvement project commission. See Idaho Code 39-8103
  • Committee: means the state hazardous waste management planning committee created in section 39-5805, Idaho Code. See Idaho Code 39-5803
  • Committee membership: Legislators are assigned to specific committees by their party. Seniority, regional balance, and political philosophy are the most prominent factors in the committee assignment process.
  • Common disaster: A sudden and extraordinary misfortune that brings about the simultaneous or near-simultaneous deaths of two or more associated persons, such as husband and wife.
  • Community health center grant: means a grant awarded pursuant to this chapter. See Idaho Code 39-3203
  • Community health center grant program: means the program that administers the community health center grant fund. See Idaho Code 39-3203
  • Community health screening event: means an event sponsored by a school, a church, a civic club or another community organization for the purpose of providing health screenings by health care providers who are not compensated for their volunteer service at the event. See Idaho Code 39-7702
  • Company action level RBC: means , with respect to any insurer, the product of 2. See Idaho Code 41-5401
  • Compensation: means any remuneration, whether by way of salary, fee or otherwise, for health care services rendered. See Idaho Code 39-7702
  • Complication: means an abnormal or a deviant process or event arising from the performance or completion of an abortion, as follows:

  • Concurrent planning: means a planning model that prepares for and implements different outcomes at the same time. See Idaho Code 30-21-414
  • Concurrent resolution: A legislative measure, designated "S. Con. Res." and numbered consecutively upon introduction, generally employed to address the sentiments of both chambers, to deal with issues or matters affecting both houses, such as a concurrent budget resolution, or to create a temporary joint committee. Concurrent resolutions are not submitted to the President/Governor and thus do not have the force of law.
  • Consent to care: includes refusal to consent to care and/or withdrawal of care. See Idaho Code 39-4502
  • Consignee: means a person named in a bill of lading to which or to whose order the bill promises delivery. See Idaho Code 28-7-102
  • Consignor: means a person named in a bill of lading as the person from which the goods have been received for shipment. See Idaho Code 28-7-102
  • Consistent with the least restrictive alternative principle: means that services are delivered in the setting which places the fewest restrictions on the personal liberty of the child, and provides the greatest integration with individuals who do not have disabilities, in typical and age appropriate, school, community and family environments, which is consistent with safe, effective and cost-effective treatment for the child and family.   • Construction: means the erection, fabrication, reconstruction, demolition, alteration, conversion, or repair of a building, or the installation of equipment therein normally a part of the structure. See Idaho Code 39-4105
  • Consumptive use: means that portion of the annual volume of water diverted under a water right that is transpired by growing vegetation, evaporated from soils, converted to nonrecoverable water vapor, incorporated into products, or otherwise does not return to the waters of the state. See Idaho Code 42-202B
  • Continuance: Putting off of a hearing ot trial until a later time.
  • Contract: means an annuity contract. See Idaho Code 41-3001
  • Contract for sale: includes both a present sale of goods and a contract to sell goods at a future time. See Idaho Code 28-2-106
  • contract owner: means the person who is identified as the legal owner under the terms of the policy or contract or who is otherwise vested with legal title to the policy or contract through a valid assignment completed in accordance with the terms of the policy or contract and properly recorded as the owner on the books of the insurer. See Idaho Code 41-4305
  • Contribution: means the amount paid or payable by the employer or employee into the trust fund. See Idaho Code 41-4102
  • controlled: has the meaning ascribed in section 41-3802(2), Idaho Code. See Idaho Code 41-1702
  • Controlled insurer: means a licensed insurer which is controlled, directly or indirectly, by a broker. See Idaho Code 41-1702
  • Controlling broker: means a broker who, directly or indirectly, controls an insurer. See Idaho Code 41-1702
  • Controlling person: means any person, firm, association or corporation who directly or indirectly has the power to direct or cause to be directed, the management, control or activities of the reinsurance intermediary. See Idaho Code 41-5102
  • Conversion: means a transaction authorized by part 4 of this chapter. See Idaho Code 30-22-102
  • Converted entity: means the converting entity as it continues in existence after a conversion. See Idaho Code 30-22-102
  • Converting entity: means the domestic entity that approves a plan of conversion pursuant to section 30-22-403, Idaho Code, or the foreign entity that approves a conversion pursuant to the law of its jurisdiction of formation. See Idaho Code 30-22-102
  • Conveyance: includes elevators, escalators, moving walks, platform lifts, material lifts, and dumbwaiters. See Idaho Code 39-8603
  • Cooperative agreement: means a written agreement between two (2) or more health care providers for the sharing, allocation or referral of patients, or the sharing or allocation of personnel, instructional programs, support services and facilities, medical, diagnostic, therapeutic or procedures or other services customarily offered by health care providers.   • Corrective order: means an order issued by the director specifying corrective actions which the director has determined are required. See Idaho Code 41-5401
  • Council: means the Idaho council on domestic violence and victim assistance created in section 39-5203, Idaho Code. See Idaho Code 39-5202
  • Council: means the "Big Payette Lake Water Quality Council" established in this chapter. See Idaho Code 39-6602
  • Council: means a regional air quality council established pursuant to this chapter. See Idaho Code 39-6705
  • County: means the county where the waste tire storage site is located. See Idaho Code 39-6501
  • County: means any county in the state of Idaho. See Idaho Code 39-7403

  • Court: means district court or magistrate’s division thereof, or if the context requires, a magistrate or judge thereof. See Idaho Code 30-21-414

  • Court reporter: A person who makes a word-for-word record of what is said in court and produces a transcript of the proceedings upon request.
  • Cover material: means soil or other suitable material that is used to protect the active portion of the MSWLF unit. See Idaho Code 39-7403
  • Covered policy: means a policy or contract or portion of a policy or contract for which coverage is provided under section 41-4303, Idaho Code. See Idaho Code 41-4305
  • CPR: means measures to restore cardiac function and/or to support ventilation in the event of cardiac or respiratory arrest. See Idaho Code 39-4502
  • Crisis line: means an emergency twenty-four (24) hour telephone service staffed by persons able to provide information and referral to community services. See Idaho Code 39-5202
  • Cross examine: Questioning of a witness by the attorney for the other side.
  • Custodian: means a person, other than a parent or legal guardian, to whom legal or joint legal custody of the child has been given by court order. See Idaho Code 30-21-414
  • Customer: means any person having an account with a bank or for whom a bank has agreed to collect items, including a bank that maintains an account at another bank;

  • Dairy environmental management plan: means a plan for managing a dairy environmental management system. See Idaho Code 37-604
  • Dairy environmental management system: means the areas and structures within a dairy farm where dairy byproducts are collected, stored, treated or applied to land. See Idaho Code 37-604
  • Dairy farm: means land owned or operated by a department-permitted grade A or manufacture grade facility where one (1) or more milking cows, sheep or goats are kept, and from which all or a portion of the milk produced thereon is delivered, sold or offered for sale for human consumption. See Idaho Code 37-604
  • Dairy nutrient management plan: means a plan prepared in conformance with the nutrient management standard for managing the land application of dairy byproducts that is prepared by a certified planner and approved by the department. See Idaho Code 37-604
  • Dairy storage and containment facilities: means the areas and structures within a dairy farm where dairy byproducts are collected, stored or treated in conformance with engineering standards and specifications published by the United States department of agriculture natural resources conservation service or by the American society of agricultural and biological engineers (ASABE), or other equally protective criteria approved by the director. See Idaho Code 37-604
  • Daycare: means care and supervision provided for compensation during part of a twenty-four (24) hour day, for a child or children not related by blood, marriage or legal guardianship to the person or persons providing the care, in a place other than the child’s or children’s own home or homes. See Idaho Code 39-1102
  • Daycare facility: means a place or facility providing daycare services for compensation to seven (7) or more children not related to the provider. See Idaho Code 39-1102
  • Death master file: means the United States social security administration’s death master file or any other database or service that is at least as comprehensive as the United States social security administration’s death master file for determining that a person has reportedly died. See Idaho Code 41-3001
  • Death master file match: means a search of the death master file that results in a match of the social security number or the name and date of birth of an insured, annuity owner or retained asset account holder. See Idaho Code 41-3001
  • Deed: The legal instrument used to transfer title in real property from one person to another.
  • Delinquency: means unpaid support for a minor child or spouse which has accrued under an order. See Idaho Code 28-4-628
  • Delivery order: means a record that contains an order to deliver goods directed to a warehouse, carrier, or other person that in the ordinary course of business issues warehouse receipts or bills of lading. See Idaho Code 28-7-102
  • Delivery sale: means to distribute tobacco products or electronic cigarettes to a consumer in a state where either: (a) the individual submits the order for such sale by means of a telephonic or other method of voice transmission, data transfer via computer networks, including the internet and other online services, or facsimile, or the mails; or (b) the tobacco products or electronic cigarettes are delivered by use of the mails or a delivery service.   • Delivery service: means any person who is engaged in the commercial delivery of letters, packages or other containers. See Idaho Code 39-5702
  • Department: means the Idaho department of agriculture. See Idaho Code 37-604

  • Electronic cigarette: includes the components of an electronic cigarette including, but not limited to, liquid nicotine. See Idaho Code 39-5702
  • Electronic claim: means a claim that is transmitted through the use of electronic media, which includes the internet, extranet, leased lines, dial-up lines, private networks, and those transmissions that are physically moved from one (1) location to another using magnetic tape, disk or compact disk media. See Idaho Code 41-5601
  • Electronic funds transfer: The transfer of money between accounts by consumer electronic systems-such as automated teller machines (ATMs) and electronic payment of bills-rather than by check or cash.   • Elevator: means a hoisting or lowering machine equipped with a car or platform that moves in guides and services two (2) or more floors or landings of a building or structure. See Idaho Code 39-8603
  • Eligible employee: means an employee who works on a full-time basis and has a normal work week of thirty (30) or more hours or, by agreement between the employer and the carrier, an employee who works between twenty (20) and thirty (30) hours per week. See Idaho Code 41-4703

  • Emergency: means a situation in which the child’s condition, as evidenced by recent behavior, poses a significant threat to the health or safety of the child, his family or others, or poses a serious risk of substantial deterioration in the child’s condition which cannot be eliminated by the use of supportive services or intervention by the child’s parents, or mental health professionals, and treatment in the community while the child remains in his family home.   • Emergency: means a release or threat of release that, in the reasonable judgment of the local emergency response authority in consultation with the office, threatens immediate harm to the environment or the health and safety of any individual and that requires immediate action for the containment or control of a hazardous or potentially hazardous substance to prevent, minimize or mitigate harm to the public health, safety or the environment which may result if action is not taken.   • Emergency medical services personnel: means personnel engaged in providing initial emergency medical assistance including, but not limited to, first responders, emergency medical technicians and paramedics. See Idaho Code 39-4502
  • Employee: means any person working for compensation in a facility that provides daycare. See Idaho Code 39-1102
  • Employer: means any person, partnership, limited liability company, association, corporation or nonprofit entity that employs one (1) or more persons, including the legislative, executive and judicial branches of state government; any county, city, or any other political subdivision of the state; or any other separate unit of state or local government.   • Employer: means any person, partnership, limited liability company, association, corporation, labor organization, employment agency or nonprofit entity that employs five (5) or more persons including relatives, and including the legislative, executive and judicial branches of state government; any county, city, or any other political subdivision of the state; or any other separate unit of state or local government.   • Facility: means any public or private hospital, clinic, center, medical school, medical training institution, health care facility, physician’s office, infirmary, dispensary, ambulatory surgical center or other institution or location where medical care is provided to any person.   • Facility: means a residential care or assisted living facility. See Idaho Code 39-3302

  • Federal fiscal year: means the twelve (12) months which commence the first day of October in each year and close on the thirtieth day of September of the following year. See Idaho Code 39-6105
  • Fee simple: Absolute title to property with no limitations or restrictions regarding the person who may inherit it.

  • financing authority: means the entity established by the authority of this chapter, and agreements, compacts, reciprocal legislation or resolutions with or by the United States of America, the Coeur d’Alene tribe or the state of Washington to accept and invest funds and finance the activities of the basin project.   • Fingerprints: means an impression of the lines on the finger taken for purpose of identification. See Idaho Code 41-5802
  • Fireworks: means any combustible or explosive composition, or any substance or combination of substances, or article prepared for the purpose of producing a visible or audible effect by combustion, explosion, deflagration or detonation. See Idaho Code 39-2602
  • Fiscal intermediary agency: means an entity that provides services that allow the participant receiving personal assistance services, or his designee or legal representative, to choose the level of control he will assume in recruiting, selecting, managing, training and dismissing his personal assistant and over the manner in which services are delivered.   • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30.   • Informed consent to treatment: means a knowing and voluntary decision to undergo a specific course of treatment, evidenced in writing, and made by an emancipated child, or a child’s parent, or guardian, who has the capacity to make an informed decision, after the staff of the facility or other provider of treatment have explained the nature and effects of the proposed treatment.   • Interest holder liability: means :

  • Investment adviser: means a person that, for compensation, engages in the business of advising others, either directly or through publications or writings, as to the value of securities or the advisability of investing in, purchasing or selling securities or that, for compensation and as a part of a regular business, issues or promulgates analyses or reports concerning securities.   • Investment adviser representative: means an individual employed by or associated with an investment adviser or federal covered investment adviser who makes any recommendations or otherwise gives investment advice regarding securities, manages accounts or portfolios of clients, determines which recommendation or advice regarding securities should be given, provides investment advice or holds herself or himself out as providing investment advice, receives compensation to solicit, offer, or negotiate for the sale of or for selling investment advice, or supervises employees who perform any of the foregoing.   • Involuntary treatment: means treatment, services and placement of children provided without consent of the parent of a child, under the authority of a court order obtained pursuant to this chapter, as directed by an order of disposition issued by a designated employee of the department of health and welfare under section 16-2415, Idaho Code.   • Irrevocable trust: A trust arrangement that cannot be revoked, rescinded, or repealed by the grantor.
  • Issuer: means a bailee that issues a document of title or, in the case of an unaccepted delivery order, the person that orders the possessor of goods to deliver. See Idaho Code 28-7-102

  • Joint session: When both chambers of a legislature adopt a concurrent resolution to meet together.
  • Joint tenancy: A form of property ownership in which two or more parties hold an undivided interest in the same property that was conveyed under the same instrument at the same time. A joint tenant can sell his (her) interest but not dispose of it by will. Upon the death of a joint tenant, his (her) undivided interest is distributed among the surviving joint tenants.
  • Jurisdiction of formation: means the jurisdiction whose law includes the organic law of an entity. See Idaho Code 30-21-102

  • Likely to cause harm to others: means that, as evidenced by recent behavior causing, attempting, or threatening such harm with the apparent ability to complete the act, a child is likely to cause physical injury or physical abuse to another person. See Idaho Code 30-23-104
  • Limited cooperative association: means a foreign limited cooperative association. See Idaho Code 30-21-102
  • Limited liability company: means a domestic limited liability company formed under or subject to chapter 25, title 30, Idaho Code, or a foreign limited liability company. See Idaho Code 30-21-102

  • Manifested waste: means waste which at the point of origin or generation is required to be manifested for transportation in a manner similar to that of the federal uniform hazardous waste manifest or by other manifest requirements designed to assure proper treatment, storage and disposal of such waste.   • Manufactured home: means a structure, constructed after June 15, 1976, in accordance with the HUD manufactured home construction and safety standards, and is transportable in one (1) or more sections, which, in the traveling mode, is eight (8) body feet or more in width or is forty (40) body feet or more in length, or when erected on site, is three hundred twenty (320) or more square feet, and which is built on a permanent chassis and designed to be used as a dwelling with or without a permanent foundation when connected to the required utilities, and includes the plumbing, heating, air conditioning, and electrical systems contained therein, except that such term shall include any structure which meets all the requirements of this subsection except the size requirements and with respect to which the manufacturer voluntarily files a certification required by the secretary of housing and urban development and complies with the standards established under 42 U.   • Merger: means a transaction in which two (2) or more merging entities are combined into a surviving entity pursuant to a record filed by the secretary of state. See Idaho Code 30-22-102

  • Nutrient management plan: means a plan prepared in compliance with the nutrient management standard or other equally protective standard approved by the director for managing the amount, source, placement, form and timing of the land application of nutrients and soil amendments for plant production and to minimize the potential for environmental degradation, particularly of water quality.   • Nutrient management standard: means the standard of the United States department of agriculture, natural resource conservation service code 590 or the Idaho agricultural pollution abatement plan, nutrient management standard component practice. See Idaho Code 39-7903

  • Person: means an individual, a corporation, a limited liability company, a partnership, an association, a joint stock company, a business trust, an unincorporated organization, or any similar entity or any combination of the foregoing acting in concert, but shall not include any joint venture partnership exclusively engaged in owning, managing, leasing or developing real or tangible personal property. See Idaho Code 41-3802
  • Person: means any individual, public or private corporation, partnership, joint venture, association, firm, trust, estate, the United States or any department, institution, or agency thereof, the state or any department, institution, or agency thereof, any municipal corporation, county, city, or other political subdivision of the state, or any other legal entity whatsoever which is recognized by law as the subject of rights and duties. See Idaho Code 39-7103
  • Person: means any individual, corporation, association, firm, syndicate, organization or other entity. See Idaho Code 41-4102
  • Person: means any individual, association, partnership, firm, joint stock company, trust, estate, political subdivision, public or private corporation, state or federal governmental department, agency or instrumentality, or any other legal entity which is recognized by law as the subject of rights and duties. See Idaho Code 39-7203
  • Person: means an individual, corporation, limited liability company, partnership, association, governmental body or entity or voluntary organization. See Idaho Code 41-4305
  • Person: means an individual; corporation; business trust; estate; trust; partnership; limited liability company; association; joint venture; government; governmental subdivision, agency, or instrumentality; public corporation; or any other legal or commercial entity. See Idaho Code 30-14-102
  • Person: means an individual, association, firm, partnership, political subdivision, public or private corporation, state or federal agency, municipality, industry, or any other legal entity whatsoever. See Idaho Code 39-7403
  • Person: means any individual, association, partnership, firm, joint stock company, trust, estate, political subdivision, public or private corporation, state or federal governmental department, agency, or instrumentality, or any other legal entity which is recognized by law as the subject of rights and duties. See Idaho Code 39-4403
  • Person: means an individual, business corporation, nonprofit corporation, partnership, limited partnership, limited liability company, general cooperative association, limited cooperative association, unincorporated nonprofit association, statutory trust, business trust, common-law business trust, estate trust, association, joint venture, public corporation, government or governmental subdivision, agency, or instrumentality, or any other legal or commercial entity. See Idaho Code 30-21-102
  • Person: means an individual, association, firm, partnership, political subdivision, public or private corporation, state or federal agency, municipality, industry or any other legal entity whatsoever, and includes owners and operators. See Idaho Code 39-7903
  • Personal assistance agency: means an entity that recruits, hires, fires, trains, supervises, schedules, oversees quality of work, takes responsibility for services provided, provides payroll and benefits for personal assistants working for them, is the employer of record and in fact. See Idaho Code 39-5602
  • Personal assistance services: includes both attendant care services and personal care services and means services that involve personal and medically oriented tasks dealing with the functional needs of the participant and accommodating the participant’s needs for long-term maintenance, supportive care or IADLs. See Idaho Code 39-5602
  • Personal assistant: means an individual who directly provides personal assistance services. See Idaho Code 39-5602
  • Petitioning physician: means the foreign physician, named in the J-1 visa waiver or national interest waiver application, who requires a waiver to remain in the United States to practice medicine. See Idaho Code 39-6105
  • Petroleum: includes petroleum asphalt and crude oil or any part of petroleum asphalt or crude oil that is liquid at standard conditions of temperature and pressure (sixty (60) degrees Fahrenheit and fourteen and seven-tenths (14. See Idaho Code 39-7203
  • Photographic identification: means state, district, territorial, possession, provincial, national or other equivalent government driver’s license, identification card or military card, in all cases bearing a photograph and a date of birth, or a valid passport. See Idaho Code 39-5702
  • Physician: means a person who holds a current active license to practice medicine and surgery or osteopathic medicine and surgery in Idaho and is in good standing with no restriction upon or actions taken against his or her license. See Idaho Code 39-4502
  • Physician assistant: means a health care provider licensed pursuant to chapter 18, title 54, Idaho Code. See Idaho Code 39-5903
  • Plaintiff: The person who files the complaint in a civil lawsuit.
  • Plan: means a plan of merger, plan of interest exchange, plan of conversion or plan of domestication. See Idaho Code 30-22-102
  • Plan: means the state hazardous waste management plan prepared under the provisions of section 39-5806, Idaho Code. See Idaho Code 39-5803
  • Plan: means the comprehensive water quality management plan for the lake to be developed after the initial study, and as modified over time. See Idaho Code 39-6602
  • plan: means any public agency plan established by a joint powers agreement and under which payment for any disability benefits not otherwise provided for under title 72, Idaho Code (worker’s compensation and related laws — industrial commission), medical, surgical, hospital, and other services for prevention, diagnosis, or treatment of any disease, injury, or bodily condition of an employee is, or is to be, regularly provided for or promised from funds created or maintained in whole or in part by contributions or payments thereto by a public agency employer, or by a public agency employer and the employees of the public agency, and not otherwise covered by insurance or contract with a health care service corporation, health maintenance organization, or similar other third party prepayment plan.   • Plan of conversion: means a plan under section 30-22-402, Idaho Code. See Idaho Code 30-22-102
  • Plan of domestication: means a plan under section 30-22-502, Idaho Code. See Idaho Code 30-22-102
  • Plan of interest exchange: means a plan under section 30-22-302, Idaho Code. See Idaho Code 30-22-102
  • Plan of merger: means a plan under section 30-22-202, Idaho Code. See Idaho Code 30-22-102
  • Plan of operation: means the plan of operation of the individual high risk reinsurance pool established pursuant to this chapter. See Idaho Code 41-5501
  • Plan of operation: means the plan of operation of the fund as established by the board. See Idaho Code 41-6002
  • Plan of operation: means the plan of operation of the program established pursuant to section 41-4711, Idaho Code. See Idaho Code 41-4703
  • Plan of operation: means the written plan developed by an owner or operator of a MSWLF unit detailing how the facility is to be operated during its active life, during closure, and throughout the post closure period. See Idaho Code 39-7403
  • Plan of operation or feasibility study: means an analysis which presents the expected activities and results of a risk retention group, including, at a minimum:
  • Idaho Code 41-4803
  • Planning horizon: refers to the length of time that the department determines is reasonable for a municipal provider to hold water rights to meet reasonably anticipated future needs. See Idaho Code 42-202B
  • Platform lift: means a hoisting and lowering mechanism that moves within a guide system and serves two (2) or more landings, and may include vertical or inclined platform lifts used by persons who are mobility impaired. See Idaho Code 39-8603
  • Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
  • Point of compliance: means a vertical surface located at the hydraulically downgradient intercept with the uppermost aquifer at which a release from a waste management unit measured as change in constituent values will trigger assessment monitoring. See Idaho Code 39-7403
  • Policy: means any policy or certificate of life insurance that provides a death benefit. See Idaho Code 41-3001
  • Political subdivision: means a city or county. See Idaho Code 39-3302
  • Political subdivision: means a city or county. See Idaho Code 39-3502
  • Pollution: means water pollution as defined in section 39-103, Idaho Code. See Idaho Code 39-6602
  • Pool: means the Idaho [individual] high risk reinsurance pool. See Idaho Code 41-5501
  • Post closure: means the requirements placed upon the MSWLF unit after closure to ensure their environmental safety for a thirty (30) year period or until the site becomes stabilized in accordance with section 39-7416, Idaho Code. See Idaho Code 39-7403
  • Potentially hazardous substance: means any substance which in the reasonable judgment of the local emergency response authority in consultation with the office is likely a hazardous substance. See Idaho Code 39-7103
  • Power of attorney: A written instrument which authorizes one person to act as another's agent or attorney. The power of attorney may be for a definite, specific act, or it may be general in nature. The terms of the written power of attorney may specify when it will expire. If not, the power of attorney usually expires when the person granting it dies. Source: OCC
  • Practitioner: means a licensee of this state authorized to practice medicine and surgery, psychology, chiropractic, law or any other licensee of the state whose services are compensated, directly or indirectly, by insurance proceeds, or a licensee similarly licensed in other states and nations or the practitioner of any nonmedical treatment rendered in accordance with a recognized religious method of healing. See Idaho Code 41-291
  • Practitioner or facility: means any physician, hospital or other person or facility licensed or otherwise authorized to furnish health care services. See Idaho Code 41-5601
  • Precedent: A court decision in an earlier case with facts and law similar to a dispute currently before a court. Precedent will ordinarily govern the decision of a later similar case, unless a party can show that it was wrongly decided or that it differed in some significant way.
  • Predecessor act: means the act repealed by section 30-14-702, Idaho Code. See Idaho Code 30-14-102
  • pregnancy: means the reproductive condition of having an unborn child in the uterus. See Idaho Code 39-9503
  • Premium: means all moneys paid by a small employer and eligible employees as a condition of receiving coverage from a small employer carrier, including any fees or other contributions associated with the health benefit plan. See Idaho Code 41-4703
  • Premium: means all moneys paid by an individual and eligible dependents as a condition of receiving coverage from a carrier, including any fees or other contributions associated with the health benefit plan. See Idaho Code 41-5203
  • Premiums: shall mean premiums, rates, dues or other required contributions by whatever name known, which are payable under the certificate. See Idaho Code 41-3204
  • Premiums: means amounts or considerations, by whatever name called, received on covered policies or contracts less returned premiums, considerations and deposits and less dividends and experience credits. See Idaho Code 41-4305
  • President pro tempore: A constitutionally recognized officer of the Senate who presides over the chamber in the absence of the Vice President. The President Pro Tempore (or, "president for a time") is elected by the Senate and is, by custom, the Senator of the majority party with the longest record of continuous service.
  • Pretrial conference: A meeting of the judge and lawyers to discuss which matters should be presented to the jury, to review evidence and witnesses, to set a timetable, and to discuss the settlement of the case.
  • Primary care: means a medical doctor or doctor of osteopathy licensed in pediatrics, family medicine, internal medicine, obstetrics, gynecology, general surgery or psychiatry. See Idaho Code 39-6105
  • Principal office: means the principal executive office of an entity, whether or not the office is located in this state. See Idaho Code 30-21-102
  • principal place of business: means the state where the insured maintains its headquarters and where the insured’s high level officers direct, control and coordinate the business activities of the insured. See Idaho Code 41-1213
  • Private emergency response plan: means a plan designed to respond to emergency releases of hazardous or potentially hazardous substances at a specific facility or under a specific set of conditions. See Idaho Code 39-7103
  • Private forest lands: means forest lands not owned by the federal government, state government, an Indian tribe or a political subdivision of the state. See Idaho Code 38-1502
  • Private genetic information: means any information about an identifiable individual that is derived from the presence, absence, alteration or mutation of an inherited gene or genes, or the presence or absence of a specific DNA marker or markers, and which has been obtained from a genetic test or analysis of the individual’s DNA or from a genetic test or analysis of a person’s DNA of whom the individual is a blood relative. See Idaho Code 39-8302
  • Probable cause: A reasonable ground for belief that the offender violated a specific law.
  • Probate: Proving a will
  • Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
  • Proceeding: includes a civil action, arbitration, mediation, administrative proceeding, criminal prosecution and investigatory action. See Idaho Code 30-21-102
  • Processing: means an operation conducted on solid waste to prepare it for disposal. See Idaho Code 39-7403
  • Product liability: means liability for damages because of any personal injury, death, emotional harm, consequential economic damage or property damage (including damages resulting from the loss of use of property) arising out of the manufacture, design, importation, distribution, packaging, labeling, lease, or sale of a product, but does not include the liability of any person for those damages if the product involved was in the possession of such a person when the incident giving rise to the claim occurred. See Idaho Code 41-4803
  • Professional entity: means an entity formed for the sole and specific purpose of rendering professional services, allied professional services, and services ancillary to the professional services and that has as its interest holders only:

  • Program: means all the actions to be performed by the council pursuant to this chapter. See Idaho Code 39-6602
  • Program: means the Idaho small employer reinsurance program created in section 41-4711, Idaho Code. See Idaho Code 41-4703
  • Property: means all property, whether real, personal, or mixed or tangible or intangible, or any right or interest therein. See Idaho Code 30-21-102
  • Property and casualty insurer: means any insurer licensed under chapter 3, title 41, Idaho Code, to transact property and casualty insurance, but shall not include monoline mortgage guaranty insurers, financial guaranty insurers, title insurers, farm and county mutuals and domestic reciprocal insurers with fewer than seven (7) subscribers which insure only worker’s compensation risk in this state and which only issue fully assessable policies.   • Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government.
  • Protected agreement: means :

  • Protective order: means an order issued by the court in a child protection case, prior to the adjudicatory hearing, to enable the child to remain in the home pursuant to section 16-1615(8), Idaho Code[,] or following an adjudicatory hearing to preserve the unity of the family and to ensure the best interests of the child, pursuant to section 16-1619(10), Idaho Code. See Idaho Code 30-21-414
  • Protective supervision: is a legal status created by court order in a child protective case whereby the child is in the legal custody of his or her parent(s), guardian(s) or other legal custodian(s), subject to supervision by the department. See Idaho Code 30-21-414
  • Provider: means a personal assistance agency, a fiscal intermediary agency or a PCS family alternate care provider. See Idaho Code 39-5602
  • provider: means any person or entity licensed, certified, or otherwise authorized by law to administer health care in the ordinary course of business or practice of a profession, including emergency or other medical services personnel. See Idaho Code 39-4502
  • Pseudoephedrine product: means any compound, mixture or preparation containing any detectable quantity of pseudoephedrine, its salts or optical isomers, or salts of optical isomers. See Idaho Code 37-3301
  • Psychotropic medication: means a drug prescribed to affect psychological functioning, perception, behavior or mood. See Idaho Code 30-21-414
  • Public adjuster: means any person who, for compensation or any other thing of value on behalf of the insured:
  • Idaho Code 41-5802
  • Public agency: means any city, county or political subdivision of this state, including, but not limited to: counties; school districts; highway districts; port authorities; instrumentalities of counties, county hospitals, cities or any political subdivision created under the laws of the state of Idaho; and the state of Idaho and any agency of the state government. See Idaho Code 41-4102
  • Public law: A public bill or joint resolution that has passed both chambers and been enacted into law. Public laws have general applicability nationwide.
  • Public meeting: means all meetings open to the public. See Idaho Code 39-5502
  • Public organic record: means the record, the filing of which by the secretary of state is required to form an entity, and any amendment to or restatement of that record. See Idaho Code 30-21-102
  • Public place: means any enclosed indoor place of business, commerce, banking, financial service or other service-related activity, whether publicly or privately owned and whether operated for profit or not, to which persons not employed at the public place have general and regular access or which the public uses including:

  • public record: means information that is inscribed on a tangible medium or that is stored in an electronic or other medium and is retrievable in perceivable form. See Idaho Code 30-14-102
  • Publicly-owned building or office: means any enclosed indoor place or portion of a place owned, leased or rented by any state, county or municipal government, or by any agency supported by appropriation of, or by contracts or grants from, funds derived from the collection of federal, state, municipal or county taxes. See Idaho Code 39-5502
  • Purchasing group: means any group which:

  • QEI: means a person who is currently certified by the National Association of Elevator Safety Authorities International (NAESA International) accredited certifying organization as meeting the requirements of the NAESA International QEI-1 standard, and who is employed by or under contract to the division of building safety.   • Qualified medical education debt: means a debt with a financial aid program or financial institution incurred to meet the educational costs of attending a medical school. See Idaho Code 39-5903
  • Qualified professional: means a licensed professional geologist or licensed professional engineer, as appropriate, holding current professional registration in compliance with applicable provisions of the Idaho Code. See Idaho Code 39-7403
  • Qualified United States financial institution: means for purposes of this chapter, a qualified United States financial institution that:

  • Qualifying remediation costs: means reasonable costs incurred performing remediation activities integral to achieving the cleanup goals identified in a remediation work plan approved by the department. See Idaho Code 39-7203
  • Quality control and quality assurance program: means the laboratory procedures implemented to ensure that operator bias, systematic and nonsystematic methodological errors, and equipment-related problems do not affect the results of the testing. See Idaho Code 39-8902
  • Quorum: The number of legislators that must be present to do business.
  • Random unannounced inspection: means an inspection of retail outlets by a law enforcement agency or by the department, with or without the assistance of a minor, to monitor compliance of this chapter. See Idaho Code 39-5702
  • Range fire: means any fire burning uncontrolled on any range land. See Idaho Code 38-101
  • Range land: means any land which is not cultivated and which has upon it native grasses or other forage plants making it best suited for grazing of domestic and wild animals and which land is adjacent to or intermingled with forest land. See Idaho Code 38-101
  • Rating organization: means every person, other than an authorized insurer, whether located within or outside this state, who has as his object or purpose the making of rates, rating plans or rating systems. See Idaho Code 41-1436
  • Rating period: means the calendar period for which premium rates established by a small employer carrier are assumed to be in effect. See Idaho Code 41-4703
  • Rating period: means the calendar period for which premium rates established by a carrier are assumed to be in effect. See Idaho Code 41-5203
  • Ratio: means the number of staff required to supervise a certain number of children. See Idaho Code 39-1102
  • RBC: means risk-based capital. See Idaho Code 41-5401
  • RBC instructions: means the RBC report, including risk-based capital instructions adopted by the NAIC, as such RBC instructions may be amended by the NAIC from time to time in accordance with the procedures adopted by the NAIC. See Idaho Code 41-5401
  • RBC plan: means a comprehensive financial plan containing the elements specified in section 41-5403(2), Idaho Code. See Idaho Code 41-5401
  • RBC report: means the report required in section 41-5402, Idaho Code. See Idaho Code 41-5401
  • RCRA: means the resource conservation and recovery act (42 U. See Idaho Code 39-7403
  • RCRA: means the resource conservation and recovery act of 1976 as amended from time to time. See Idaho Code 39-4403
  • Reasonable and prudent parent standard: means the standard of care characterized by careful and sensible parental decisions that maintain the health, safety and best interests of a child while simultaneously encouraging the emotional and developmental growth of the child that a caregiver shall use when determining whether to allow a child in foster care under the responsibility of the state to participate in extracurricular, enrichment, cultural or social activities. See Idaho Code 30-21-414
  • Reasonably anticipated future needs: refers to future uses of water by a municipal provider for municipal purposes within a service area which, on the basis of population and other planning data, are reasonably expected to be required within the planning horizon of each municipality within the service area not inconsistent with comprehensive land use plans approved by each municipality. See Idaho Code 42-202B
  • Receipt: as used in this chapter , means actual receipt. See Idaho Code 30-21-102
  • Receivership court: means the court in the insolvent or impaired insurer’s state having jurisdiction over the conservation, rehabilitation or liquidation of the insurer. See Idaho Code 41-4305
  • Record: means information that is inscribed on a tangible medium or that is stored in an electronic or other medium and is retrievable in perceivable form. See Idaho Code 28-7-102
  • Recourse: An arrangement in which a bank retains, in form or in substance, any credit risk directly or indirectly associated with an asset it has sold (in accordance with generally accepted accounting principles) that exceeds a pro rata share of the bank's claim on the asset. If a bank has no claim on an asset it has sold, then the retention of any credit risk is recourse. Source: FDIC
  • Recovery support services: means those ancillary, nonclinical services needed for a client to maintain substance abuse or addiction recovery. See Idaho Code 39-302
  • Recreational vehicle: means a vehicular type unit primarily designed as temporary living quarters for recreational, camping, or travel use, which either has its own motive power or is mounted on or drawn by another vehicle. See Idaho Code 39-4201
  • Refuge: means a place available on a twenty-four (24) hour, seven (7) days a week basis, to provide temporary residence to victims of domestic violence and their children. See Idaho Code 39-5202
  • Registered agent: means an agent of an entity that is authorized to receive service of any process, notice, or demand required or permitted by law to be served on the entity. See Idaho Code 30-21-102
  • Registered foreign entity: means a foreign entity that is registered to do business in this state pursuant to a statement of registration filed by the secretary of state. See Idaho Code 30-21-102
  • Registered mail: includes certified mail. See Idaho Code 73-114
  • Regulatory action level RBC: means the product of 1. See Idaho Code 41-5401
  • Regulatory authority: means the director of the Idaho department of health and welfare or the director’s designee. See Idaho Code 39-1602
  • Reinsurance intermediary: means a reinsurance intermediary-broker, or a reinsurance intermediary-manager as these terms are defined in subsections (7) and (8) of this section. See Idaho Code 41-5102
  • Reinsurance premium: means the premium set by the board pursuant to section 41-5506, Idaho Code, to be paid by a reinsuring carrier for eligible individuals ceded to the pool. See Idaho Code 41-5501
  • Reinsurer: means any person, firm, association or corporation duly licensed or authorized to do business in this state pursuant to the applicable provisions of the insurance law as an insurer with the authority to assume reinsurance. See Idaho Code 41-5102
  • Reinsuring carrier: means a carrier participating in the individual high risk reinsurance pool established by this chapter. See Idaho Code 41-5501
  • Reinsuring carrier: means a small employer carrier participating in the reinsurance program pursuant to section 41-4711, Idaho Code. See Idaho Code 41-4703
  • Reinsuring carrier: means a carrier participating in the Idaho individual high risk reinsurance pool established in chapter 55, title 41, Idaho Code. See Idaho Code 41-5203
  • Relative: means a child’s grandparent, great grandparent, aunt, great aunt, uncle, great uncle, brother-in-law, sister-in-law, first cousin, sibling and half-sibling. See Idaho Code 30-21-414
  • Release: means any spilling, leaking, pumping, pouring, emitting, emptying, discharging, escaping, dumping or disposing of a hazardous or potentially hazardous substance, or the threat of the same, into the environment. See Idaho Code 39-7103
  • Release: means any spilling, leaking, pumping, pouring, emitting, emptying, discharging, injecting, escaping, leaching, dumping, or disposing into the environment, including the abandonment or discarding of barrels, containers, or other closed receptacles containing any hazardous substance or petroleum. See Idaho Code 39-7203
  • Relevant: means information having any tendency to make the existence of any fact that is of consequence to the investigation or determination of the issue more probable or less probable than it would be without the evidence. See Idaho Code 41-291
  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • Remand: When an appellate court sends a case back to a lower court for further proceedings.
  • Remediation: means any of the following:

  • Repair: means the process of rehabilitation, upgrading or replacement of parts that are basically the same as the originals for the purpose of ensuring performance in accordance with the applicable code requirements. See Idaho Code 39-8603
  • Repeatability: means the range of values within which the repeat results of cigarette test trials from a single laboratory will fall ninety-five percent (95%) of the time. See Idaho Code 39-8902
  • Replacement: means the substitution of a device or component in its entirety with a new unit that is basically the same as the original for the purpose of ensuring performance in accordance with the applicable code requirements. See Idaho Code 39-8603
  • Reporter: Makes a record of court proceedings and prepares a transcript, and also publishes the court's opinions or decisions (in the courts of appeals).
  • Representative: means an employee of the department of health and welfare. See Idaho Code 39-5602
  • Representative of the department: means an employee of the department. See Idaho Code 39-3502
  • Rescission: The cancellation of budget authority previously provided by Congress. The Impoundment Control Act of 1974 specifies that the President may propose to Congress that funds be rescinded. If both Houses have not approved a rescission proposal (by passing legislation) within 45 days of continuous session, any funds being withheld must be made available for obligation.
  • Resident: means an adult who lives in a residential care or assisted living facility. See Idaho Code 39-3302
  • Resident: means a person to whom a contractual obligation is owed and who resides in this state on the date of entry of a court order that determines a member insurer to be an impaired insurer or a court order that determines a member insurer to be an insolvent insurer. See Idaho Code 41-4305
  • Resident: means an adult who lives in a certified family home and who requires personal assistance or supervision. See Idaho Code 39-3502
  • Residential care or assisted living facility: means a facility or residence, however named, operated on either a profit or nonprofit basis for the purpose of providing necessary supervision, personal assistance, meals and lodging to three (3) or more adults not related to the owner. See Idaho Code 39-3302
  • Restricted hazardous waste: means a waste or combination of wastes regulated as land disposal restricted pursuant to federal statutes and regulations, including 40 CFR part 268. See Idaho Code 39-4403
  • Restricted network provision: means any provision of a health benefit plan that conditions the payment of benefits, in whole or in part, on the use of health care providers that have entered into a contractual arrangement with the carrier to provide health care services to covered individuals.   • Retained asset account: means any mechanism whereby the settlement of proceeds payable under a policy or contract is accomplished by the insurer or an entity acting on behalf of the insurer depositing the proceeds into an account with check or draft writing privileges, where those proceeds are retained by the insurer or its agent, pursuant to a supplementary contract not involving annuity benefits other than death benefits.   • Risk retention group: means any corporation or other limited liability association:

  • Run-off: means any rainwater, leachate, or other liquid that drains over land from any part of a facility. See Idaho Code 39-7403
  • Run-on: means any rainwater, leachate, or other liquid that drains over land onto any part of a facility. See Idaho Code 39-7403
  • Runner: means a person who procures, or persons working in conjunction with each other who procure, clients at the direction of, or in cooperation with, a person who, with the intent to deceive or defraud, performs or obtains a service or benefit under a contract of insurance or asserts a claim against an insured. See Idaho Code 41-291
  • Rural health care access and physician incentive program: means the program that administers the rural health care access and physician incentive funds. See Idaho Code 39-5903
  • Rural health care access grant: means a grant awarded pursuant to this chapter. See Idaho Code 39-5903
  • Rural physician incentive fee: means the fee assessed by the state to students preparing to be physicians in the fields of medicine or osteopathic medicine who are supported by the state pursuant to an interstate compact for professional education in those fields, as those fields are defined by the compact. See Idaho Code 39-5903
  • Rural physician incentive fund: means the special revenue account in the state treasury created pursuant to section 39-5902, Idaho Code, relating to the rural health care access and physician incentive grant program. See Idaho Code 39-5903
  • Safe haven: means :

  • Safe house: means a place available on an as needed basis for temporary residence to victims of domestic violence and their children. See Idaho Code 39-5202
  • Sale: means any transfer of title or possession or both, exchange or barter, conditional or otherwise, in any manner or by any means whatever or any agreement therefor. See Idaho Code 39-8902
  • Sale: includes every contract of sale, contract to sell, or disposition of, a security or interest in a security for value. See Idaho Code 30-14-102
  • scaling: shall include any professional scaling service rendered in connection with the measurement of forest products, or supervision of scaling when such service is rendered requiring the application of scaling principles and data. See Idaho Code 38-1202
  • seal: includes an impression of such seal upon the paper, alone, as well as upon wax or a wafer affixed thereto; or, alternatively, the seal may be the mark of a rubber stamp providing substantially the same information as the impression. See Idaho Code 73-111
  • Securities and exchange commission: means the United States securities and exchange commission. See Idaho Code 30-14-102
  • Security: means a note; stock; treasury stock; security future; bond; debenture; evidence of indebtedness; certificate of interest or participation in a profit-sharing agreement; collateral trust certificate; preorganization certificate or subscription; transferable share; investment contract; voting trust certificate; certificate of deposit for a security; fractional undivided interest in oil, gas or other mineral rights; put, call, straddle, option or privilege on a security, certificate of deposit, or group or index of securities, including an interest therein or based on the value thereof; put, call, straddle, option, or privilege entered into on a national securities exchange relating to foreign currency; or, in general, an interest or instrument commonly known as a "security"; or a certificate of interest or participation in, temporary or interim certificate for, receipt for, guarantee of, or warrant or right to subscribe to or purchase, any of the foregoing.   • Self-regulatory organization: means a national securities exchange registered under the securities exchange act of 1934, a national securities association of broker-dealers registered under the securities exchange act of 1934, a clearing agency registered under the securities exchange act of 1934, or the municipal securities rulemaking board established under the securities exchange act of 1934. See Idaho Code 30-14-102
  • Seller: means the person who physically sells or distributes tobacco products or electronic cigarettes. See Idaho Code 39-5702
  • Seller: means a person who sells or contracts to sell goods. See Idaho Code 28-2-103
  • Sequester: To separate. Sometimes juries are sequestered from outside influences during their deliberations.
  • Serious emotional disturbance: means an emotional or behavioral disorder, or a neuropsychiatric condition which results in a serious disability, and which requires sustained treatment interventions, and causes the child’s functioning to be impaired in thought, perception, affect or behavior. See Idaho Code 30-23-104
  • Service area: means that area within which a municipal provider is or becomes entitled or obligated to provide water for municipal purposes. See Idaho Code 42-202B
  • Service coordination: means a case management activity that assists individuals eligible for medicaid in gaining and coordinating access to necessary care and services appropriate to the needs of the individual. See Idaho Code 39-5602
  • Shelter care: means places designated by the department for temporary care of children pending court disposition or placement. See Idaho Code 30-21-414
  • Shipper: means a person that enters into a contract of transportation with a carrier. See Idaho Code 28-7-102
  • Sign: means with present intent to authenticate or adopt a record:

  • Site: means a parcel of real estate for which an application has been submitted under section 39-7204, Idaho Code. See Idaho Code 39-7203
  • slashing: shall mean brush, severed limbs, poles, tops and/or other waste material incident to such cutting or to the clearing of land, which are four (4) inches and under in diameter. See Idaho Code 38-101
  • Sliding fee discount schedule: means a written delineation documenting the value of charge discounts granted to patients based upon financial hardship and federal poverty guidelines. See Idaho Code 39-6105
  • Sludge: means any solid, semisolid, or liquid waste generated from a municipal, commercial, or industrial waste water treatment plant, water supply treatment plant or air pollution control facility exclusive of the treated effluent from a waste water treatment plant. See Idaho Code 39-7403
  • Small employer: means any person, firm, corporation, partnership or association that is actively engaged in business that employed an average of at least two (2) but no more than fifty (50) eligible employees on business days during the preceding calendar year and that employs at least two (2) but no more than fifty (50) eligible employees on the first day of the plan year, the majority of whom were and are employed within this state. See Idaho Code 41-4703
  • Small employer basic health benefit plan: means a lower cost health benefit plan developed pursuant to section 41-4712, Idaho Code. See Idaho Code 41-4703
  • Small employer carrier: means a carrier that offers health benefit plans covering eligible employees of one (1) or more small employers in this state. See Idaho Code 41-4703
  • Small employer catastrophic health benefit plan: means a higher limit health benefit plan developed pursuant to section 41-4712, Idaho Code. See Idaho Code 41-4703
  • Small employer standard health benefit plan: means a health benefit plan developed pursuant to section 41-4712, Idaho Code. See Idaho Code 41-4703
  • Smoking: includes the possession of any lighted tobacco product in any form. See Idaho Code 39-5502
  • Society: shall mean fraternal benefit society, unless otherwise indicated. See Idaho Code 41-3204
  • Solid waste: means any garbage or refuse, sludge from a waste water treatment plant, water supply treatment plant, or air pollution control facility and other discarded material including solid, liquid, semisolid, or contained gaseous material resulting from industrial, commercial, mining, and agricultural operations and from community activities, but does not include solid or dissolved materials in domestic sewage, or solid or dissolved materials in irrigation return flows or industrial discharges that are point sources subject to permit under 33 U. See Idaho Code 39-7403
  • Special fireworks: means any fireworks designed primarily for display and classified as special fireworks by the United States bureau of explosives or designated as UN 0335 1. See Idaho Code 39-2602
  • Special therapy: means any treatment modality used to treat children with serious emotional disturbances which is subject to restrictions or special conditions imposed by the department of health and welfare rules. See Idaho Code 30-23-104
  • Species management plan: means a plan which provides for the consideration and management of a species upon its being delisted. See Idaho Code 36-2401
  • Specified regional area: means a county or counties, or a defined geographical area where air quality is threatened. See Idaho Code 39-6705
  • State: shall mean the state of Idaho. See Idaho Code 38-101
  • State: means a state or a commonwealth of the United States, the District of Columbia, Puerto Rico, and a United States possession, territory or protectorate. See Idaho Code 41-4305
  • State: means a state of the United States, the District of Columbia, Puerto Rico, the United States Virgin Islands, or any territory or insular possession subject to the jurisdiction of the United States. See Idaho Code 30-14-102
  • State: means any state of the United States or the District of Columbia. See Idaho Code 41-4803
  • State: means a state of the United States, the District of Columbia, Puerto Rico, the United States Virgin Islands, or any territory or insular possession subject to the jurisdiction of the United States. See Idaho Code 30-21-102
  • State emergency response team: means one (1) of the state emergency response teams authorized by the military division to respond to hazardous substance incidents. See Idaho Code 39-7103
  • State forester: as used in this chapter and wherever else it is used in the Idaho Code, shall mean the director of the department of lands or his duly authorized delegates or employees, including fire wardens and deputy fire wardens. See Idaho Code 38-101
  • Statement: includes , but is not limited to, any of the following regardless of how it is made and in what format it is contained:

  • Statement of conversion: means a statement under section 30-22-405, Idaho Code. See Idaho Code 30-22-102
  • Statement of domestication: means a statement under section 30-22-505, Idaho Code. See Idaho Code 30-22-102
  • Statement of interest exchange: means a statement under section 30-22-305, Idaho Code. See Idaho Code 30-22-102
  • Statement of merger: means a statement under section 30-22-205, Idaho Code. See Idaho Code 30-22-102
  • Statistically significant: means significant as determined by ANOVA analysis of variance as applied within 40 CFR 258. See Idaho Code 39-7403
  • Statute of limitations: A law that sets the time within which parties must take action to enforce their rights.
  • Statutes at large: A chronological listing of the laws enacted each Congress. They are published in volumes numbered by Congress.
  • Statutory trust: means a trust formed under the statutory law of a jurisdiction other than this state. See Idaho Code 30-21-102
  • storage: means to accumulate more than two hundred (200) waste tires at any time, in a manner that does not constitute final disposal at a waste tire disposal site, or to own or control property on which more than two hundred (200) waste tires accumulate at any given time, in a manner that does not constitute final disposal at a waste tire disposal site. See Idaho Code 39-6501
  • Storage: means the containment of hazardous wastes, on a temporary basis or for a period of years, in such a manner as not to constitute disposal of such hazardous wastes. See Idaho Code 39-4403
  • Storage facility: means a facility or part of a facility at which managed hazardous waste, as defined by rule and regulation is subject to storage. See Idaho Code 39-5803
  • Structured settlement annuity: means an annuity purchased in order to fund periodic payments for a plaintiff or other claimant in payment for or with respect to personal injury suffered by the plaintiff or other claimant. See Idaho Code 41-4305
  • study: includes any study or test, genetic or otherwise, to determine paternity or the cause of death. See Idaho Code 39-9303
  • Study: means the comprehensive, scientifically-based study of water quality in the lake. See Idaho Code 39-6602
  • Study: means the comprehensive, scientifically-based study of air quality in a specified regional area including the study of air quality in the Treasure Valley. See Idaho Code 39-6705
  • Subpoena duces tecum: A command to a witness to produce documents.
  • Subscriber: means an insurer which is furnished at its request:

  • Subsidiary: means a specified person who is an affiliate controlled by such person directly or indirectly through one (1) or more intermediaries. See Idaho Code 41-3802
  • Substance abuse: means the misuse or excessive use of alcohol or other drugs or substances. See Idaho Code 39-302
  • Substantial compliance: means a facility has no core issue deficiencies. See Idaho Code 39-3302
  • Substantial compliance: means a certified family home has no core issue deficiencies. See Idaho Code 39-3502
  • Summons: Another word for subpoena used by the criminal justice system.
  • Supervision: means administrative activity which provides the following: protection, guidance, knowledge of the resident’s general whereabouts, and assistance with activities of daily living. See Idaho Code 39-3302
  • Supportive services: means services which assist a parent with a disability to compensate for those aspects of their disability which affect their ability to care for their child and which will enable them to discharge their parental responsibilities. See Idaho Code 30-21-213
  • Supportive services: as used in this chapter , shall mean services that assist parents with a disability to compensate for those aspects of their disability that affect their ability to care for their child and that will enable them to discharge their parental responsibilities. See Idaho Code 30-21-414
  • Supportive services: means services which assist a parent with a disability to compensate for those aspects of their disability which affect their ability to care for their child and which will enable them to discharge their parental responsibilities. See Idaho Code 30-22-205
  • Supportive services: means the specific services that are provided to the resident in the community. See Idaho Code 39-3302
  • Surplus: means the excess of the assets of a self-funded plan minus the liabilities of the plan, provided the liabilities of a self-funded plan shall include the claims liability of the plan. See Idaho Code 41-4102
  • Surrogate decision maker: means the person authorized to consent to or refuse health care for another person as specified in section 39-4504(1), Idaho Code. See Idaho Code 39-4502
  • Surrogate parent: means any person appointed to act in the place of the parent of a child for purposes of developing an individual education program under the authority of the individuals with disabilities education act, 20 U. See Idaho Code 30-23-104
  • Surviving entity: means the entity that continues in existence after or is created by a merger under part 2 of this chapter. See Idaho Code 30-22-102
  • Technical committee: means the advisory committee named by the council pursuant to this chapter. See Idaho Code 39-6602
  • Technical professional: means a professional geologist or professional engineer registered in the state of Idaho. See Idaho Code 39-7203
  • Teens at risk: means individuals attending Idaho secondary public schools who have been identified as expressing or exhibiting indications of depression, suicidal inclination, emotional trauma, substance abuse or other behaviors or symptoms that indicate the existence of, or that may lead to, the development of mental illness or substance abuse. See Idaho Code 30-23-104
  • Temporary restraining order: Prohibits a person from an action that is likely to cause irreparable harm. This differs from an injunction in that it may be granted immediately, without notice to the opposing party, and without a hearing. It is intended to last only until a hearing can be held.
  • Tenancy in common: A type of property ownership in which two or more individuals have an undivided interest in property. At the death of one tenant in common, his (her) fractional percentage of ownership in the property passes to the decedent

  • Title II of the solid waste disposal act: means sections 1001 through 8006 of public law 89-272, 42 U. See Idaho Code 39-5803
  • To be in violation: means that the reinsurance intermediary, insurer or reinsurer for whom the reinsurance intermediary was acting failed to substantially comply with the provision of this chapter. See Idaho Code 41-5102
  • Tobacco product: means any substance that contains tobacco including, but not limited to, cigarettes, cigars, pipes, snuff, smoking tobacco, tobacco papers or smokeless tobacco. See Idaho Code 39-5702
  • Total adjusted capital: means the sum of:

  • Transact business: means to engage in any commercial or other activity that is intended to or likely to produce a financial benefit, whether it is for the purpose of profit to the person who engages in the activity or for the purpose of supporting a charitable, benevolent or other nonprofit function.   • Transcript: A written, word-for-word record of what was said, either in a proceeding such as a trial or during some other conversation, as in a transcript of a hearing or oral deposition.

  • transporting: means picking up or hauling waste tires. See Idaho Code 39-6501
  • Travel insurance: means insurance coverage for personal risks incident to planned travel including, but not limited to:

  • Travel retailer: means a business entity that makes, arranges or offers travel services and may offer and disseminate travel insurance as a service to its customers on behalf of and under the direction of a limited lines travel insurance producer. See Idaho Code 41-1091
  • Treasure Valley: means the geographic boundaries encompassed by Ada and Canyon counties. See Idaho Code 39-6705
  • Treasure Valley air quality council: means the regional air quality council established in section 39-6702, Idaho Code. See Idaho Code 39-6705
  • Treasure Valley air quality plan: means the comprehensive, air quality management plan for Ada and Canyon counties as developed and modified by the Treasure Valley air quality council. See Idaho Code 39-6705
  • Treatment: means the broad range of emergency, outpatient, intensive outpatient, and inpatient services and care, including diagnostic evaluation, medical, psychiatric, psychological, and social service care, vocational rehabilitation and career counseling, which may be extended to alcoholics and intoxicated persons and/or drug addicts. See Idaho Code 39-302
  • Treatment: means any method, technique, or process, including neutralization, which is designed not to be an integral part of a production process, but which is rather designed to change the physical, chemical, or biological character or composition of any hazardous waste prior to storage or final disposal so as to neutralize such waste or so as to render such waste nonhazardous or less hazardous; safer to transport, store, or dispose of; or amenable for recovery, amenable for storage or reduced in volume. See Idaho Code 39-4403
  • Treatment facility: means a facility or program meeting applicable licensing standards, that has been approved for the provisions of services under this chapter by the department of health and welfare. See Idaho Code 30-23-104

  • true name: shall include the assumed business name which appears on the application for authority to do business or registration statement. See Idaho Code 30-21-803
  • Trust account: A general term that covers all types of accounts in a trust department, such as estates, guardianships, and agencies. Source: OCC
  • Trust fund: means a fund established under a joint public agency self-funded plan for receipt of contributions of employers and employees and payment of or with respect to health care service costs of beneficiaries. See Idaho Code 41-4102
  • Type of entity: means a generic form of entity:

  • Unallocated annuity contract: means an annuity contract or group annuity certificate which is not issued to and owned by an individual, except to the extent of any annuity benefits guaranteed to an individual by an insurer under the contract or certificate. See Idaho Code 41-4305
  • Unauthorized discharge: means a discharge of pollutants from a dairy farm to waters of the United States as defined in the federal clean water act that is required to be but is not authorized by an NPDES permit. See Idaho Code 37-604
  • Unauthorized release: means a release of dairy byproducts to ground water or surface waters of the state that are not waters of the United States or beyond land owned or operated by the dairy farm that results from a dairy farm’s failure to comply with its environmental management plan. See Idaho Code 37-604
  • under common control with: means the possession, direct or indirect, of the power to direct or cause the direction of the management and policies of a person, whether through the ownership of voting securities, by contract other than a commercial contract for goods or nonmanagement services, or otherwise, unless the power is the result of an official position with or a corporate office held by the person.   • Underground storage tank system: means underground storage tank as defined by 42 U. See Idaho Code 39-8803
  • Unincorporated nonprofit association: means a domestic unincorporated nonprofit association formed under or subject to chapter 27, title 30, Idaho Code, or a nonprofit association formed under or subject to the law of a jurisdiction other than this state that would be an unincorporated nonprofit association if formed under or subject to the law of this state. See Idaho Code 30-21-102
  • Unmet need: means a vacancy or shortage of primary care or specialist physicians experienced by a community or population, as defined by federally designated health professional shortage areas or medically underserved areas/populations or as demonstrated by additional data and information required by the department. See Idaho Code 39-6105
  • Uphold: The decision of an appellate court not to reverse a lower court decision.
  • Uppermost aquifer: means the geological formation nearest the natural ground surface that is an aquifer as well as lower aquifers that are hydraulically interconnected with this aquifer within the facility’s property boundary. See Idaho Code 39-7403
  • User fees: Fees charged to users of goods or services provided by the government. In levying or authorizing these fees, the legislature determines whether the revenue should go into the treasury or should be available to the agency providing the goods or services.

  • Vacancy: means a full-time physician practice opportunity in the delivery of health care services. See Idaho Code 39-6105
  • Vaccine: means any preparations of killed microorganisms, living attenuated organisms or living fully virulent organisms that are approved by the federal food and drug administration and recommended by the federal advisory committee on immunization practices of the centers for disease control and prevention.   • Variable Rate: Having a "variable" rate means that the APR changes from time to time based on fluctuations in an external rate, normally the Prime Rate. This external rate is known as the "index." If the index changes, the variable rate normally changes. Also see Fixed Rate.
  • Vending machine: means any mechanical, electronic or other similar device which, upon the insertion of tokens, money or any other form of payment, dispenses tobacco products or electronic cigarettes. See Idaho Code 39-5702
  • Vendor assisted sales: means any sale or distribution in which the customer has no access to the product except through the assistance of the seller. See Idaho Code 39-5702
  • Venue: The geographical location in which a case is tried.
  • Vermin: means small animals, including insects, of public health and welfare concern which are difficult to control when they appear in large numbers. See Idaho Code 39-2801
  • Veto: The procedure established under the Constitution by which the President/Governor refuses to approve a bill or joint resolution and thus prevents its enactment into law. A regular veto occurs when the President/Governor returns the legislation to the house in which it originated. The President/Governor usually returns a vetoed bill with a message indicating his reasons for rejecting the measure. In Congress, the veto can be overridden only by a two-thirds vote in both the Senate and the House.
  • Voluntary provision of health care services: means providing professional services by a health care provider without compensation. See Idaho Code 39-7702
  • Voting security: means any security convertible into or evidencing a right to acquire a voting security. See Idaho Code 41-3802
  • Warehouse: means a person engaged in the business of storing goods for hire. See Idaho Code 28-7-102
  • Waste: means any solid, semisolid, liquid or contained gaseous material for which no reasonable use or reuse is intended or which is intended to be discarded. See Idaho Code 39-4403
  • Waste management unit boundary: means a vertical surface located at the hydraulically downgradient limit of the unit. See Idaho Code 39-7403
  • Waste tire: means a motor vehicle tire originally used for operation of a vehicle on a public roadway which is no longer suitable for its original intended purpose because of wear, damage or defect. See Idaho Code 39-6501
  • Waste tire storage site: means a new or existing waste tire storage site. See Idaho Code 39-6501
  • water user: means each person or entity that is a member of a lateral water users’ association because they own or possess and control land that is entitled to receive water from the point or points of delivery in the canal or reservoir, or from the point or points of diversion from waters of the state, that supplies the association’s lateral or ditch. See Idaho Code 42-1313
  • Waters of the state: means all the accumulations of water, surface and underground, natural and artificial, public and private, or parts thereof which are wholly or partially within, which flow through or border upon the state. See Idaho Code 39-7903
  • Wholesale: means sale of fireworks to a retailer or wholesaler. See Idaho Code 39-2602
  • Wholesale dealer: means any person other than a manufacturer who sells cigarettes or tobacco products to retail dealers or other persons for purposes of resale, and any person who owns, operates or maintains one (1) or more cigarette or tobacco product vending machines in, at or upon premises owned or occupied by any other person.
