  • Abandoned: means the failure of the parent to maintain a normal parental relationship with his child including, but not limited to, reasonable support or regular personal contact. See Idaho Code 16-1602

  • Animal unit: is a unit of measurement equaling two and one-half (2 1/2) swine, each weighing over twenty-five (25) kilograms (approximately fifty-five (55) pounds), or ten (10) weaned swine, each weighing under twenty-five (25) kilograms. See Idaho Code 39-7903

  • Candidate species: means a species for which the secretary of interior or secretary of commerce has on file sufficient information on biological vulnerability and threats to support a proposal to list the species as an endangered species or a threatened species, but for which listing is precluded because of pending proposals to list species that are of a higher priority.   • Care provider: means the adult member of the home family responsible for maintaining the certified family home. See Idaho Code 39-3502

  • Case law: The law as laid down in cases that have been decided in the decisions of the courts.
  • Case plan hearing: means a hearing to approve, modify or reject the case plan as provided in section 16-1621, Idaho Code. See Idaho Code 16-1602

  • Certified family home: means a family-styled living environment in which two (2) or fewer adults live who are not able to reside in their own home and who require care, help in daily living, protection and security, supervision, personal assistance and encouragement toward independence.   • Certified planner: means a person who has completed the nutrient management certification in accordance with the nutrient management standard. See Idaho Code 39-7903
  • Certified planner: means a person who has completed nutrient management certification in accordance with the nutrient management standard and is approved by the department. See Idaho Code 37-604
  • CGAD: means a confidential report filed by the insurer or insurance group made in accordance with the requirements of this chapter. See Idaho Code 41-6402
  • Charity: An agency, institution, or organization in existence and operating for the benefit of an indefinite number of persons and conducted for educational, religious, scientific, medical, or other beneficent purposes.
  • check: refers to a check or the electronic equivalent of a check, including an authorization given by a borrower to a creditor to withdraw an agreed upon amount from any account held by the borrower. See Idaho Code 28-46-401
  • Child: means a person less than thirteen (13) years of age. See Idaho Code 39-1102
  • Child: means an individual who is under the age of eighteen (18) years. See Idaho Code 16-1602
  • Child support: means a legally enforceable obligation assessed against an individual for the support of a child which shall include medical care, including health insurance premiums for the child, and any amount owing under an order for support during a period in which public assistance was expended.   • Cigarette: means any roll for smoking, whether made wholly or in part of tobacco or any other substance, irrespective of size or shape, and whether or not such tobacco or substance is flavored, adulterated or mixed with any other ingredient, the wrapper or cover of which is made of paper or any other substance or material, other than tobacco.   • Circumstances of the child: includes , but is not limited to, the joint legal custody or joint physical custody of the child. See Idaho Code 16-1602
  • Citizens committee: means the committee named by the council consisting of members of the public. See Idaho Code 39-6602
  • Citizens committee: means the committee consisting of members of the public created pursuant to section 39-6704, Idaho Code, by an air quality council established under the provisions of this chapter. See Idaho Code 39-6705
  • City: means the city where the waste tire storage site is located. See Idaho Code 39-6501
  • Civil forfeiture: The loss of ownership of property used to conduct illegal activity.
  • Claim: means any claim by or on behalf of a natural person as well as any derivative or other claim arising therefrom asserted by or on behalf of any other person. See Idaho Code 39-8704
  • Class of business: means all or a separate grouping of small employers established pursuant to section 41-4705, Idaho Code. See Idaho Code 41-4703
  • Clearing house: means an association of banks or other payors regularly clearing items;

  • commercial insurance: means property and casualty insurance pertaining to a business, profession, occupation, nonprofit organization or public entity. See Idaho Code 41-1213
  • Commercial registered agent: means a person listed under section 30-21-405, Idaho Code. See Idaho Code 30-21-102
  • Commercial solid waste: means all types of solid waste generated by stores, offices, restaurants, warehouses and other nonmanufacturing activities, excluding residential and industrial wastes. See Idaho Code 39-7403
  • Commercial solid waste facility: means a facility owned and operated as an enterprise conducted with the intent of making a profit by any individual, association, firm, or partnership for the disposal of solid waste, but excludes a facility owned or operated by a political subdivision, state or federal agency, municipality or a facility owned or operated by any individual, association, firm or partnership exclusively for the disposal of solid waste generated by such individual, association, firm or partnership.   • Commissary: means a place where food, containers or supplies are stored, prepared or packaged for transit, sale or service at other locations. See Idaho Code 39-1602
  • commission: means the entity organized by the authority of this chapter and agreements, compacts, reciprocal legislation or resolutions with or by the United States of America, the Coeur d’Alene tribe or the state of Washington to implement the basin project. See Idaho Code 39-8103
  • Commission: means the Idaho forest products commission created by section 38-1503, Idaho Code. See Idaho Code 38-1502
  • Commissioner: means a member of the board of commissioners of the basin environmental improvement project commission. See Idaho Code 39-8103

  • Committee: means the state hazardous waste management planning committee created in section 39-5805, Idaho Code. See Idaho Code 39-5803

  • Dairy farm: means land owned or operated by a department-permitted grade A or manufacture grade facility where one (1) or more milking cows, sheep or goats are kept, and from which all or a portion of the milk produced thereon is delivered, sold or offered for sale for human consumption.   • Dairy nutrient management plan: means a plan prepared in conformance with the nutrient management standard for managing the land application of dairy byproducts that is prepared by a certified planner and approved by the department. See Idaho Code 37-604
  • Dairy storage and containment facilities: means the areas and structures within a dairy farm where dairy byproducts are collected, stored or treated in conformance with engineering standards and specifications published by the United States department of agriculture natural resources conservation service or by the American society of agricultural and biological engineers (ASABE), or other equally protective criteria approved by the director.   • Daycare: means care and supervision provided for compensation during part of a twenty-four (24) hour day, for a child or children not related by blood, marriage or legal guardianship to the person or persons providing the care, in a place other than the child’s or children’s own home or homes.   • Daycare facility: means a place or facility providing daycare services for compensation to seven (7) or more children not related to the provider. See Idaho Code 39-1102
  • Death master file: means the United States social security administration’s death master file or any other database or service that is at least as comprehensive as the United States social security administration’s death master file for determining that a person has reportedly died.   • Employment contract: means a legally binding agreement between the applicant and the physician named in the J-1 visa waiver or national interest waiver application which contains all terms and conditions of employment, including, but not limited to, the salary, benefits, length of employment and any other consideration owing under the agreement.   • Endangered species: means those species listed as endangered pursuant to 16 U. See Idaho Code 36-2401

  • Facility: means a residential care or assisted living facility. See Idaho Code 39-3302
  • Facility: means all contiguous land and structures, buffer zones, and other appurtenances and improvements on the land used for the disposal of solid waste. See Idaho Code 39-7403

  • Federal fiscal year: means the twelve (12) months which commence the first day of October in each year and close on the thirtieth day of September of the following year. See Idaho Code 39-6105
  • Fee simple: Absolute title to property with no limitations or restrictions regarding the person who may inherit it.
  • Fetal death: means the death of an unborn infant prior to expulsion or extraction from the unborn infant’s mother, provided that the unborn infant reached a stage of development such that there are cartilaginous structures or fetal or skeletal parts. See Idaho Code 39-9303
  • Fifth-wheel trailer: means a vehicular unit, mounted on wheels, designed to provide temporary living quarters for recreational, camping or travel use, of such size or weight as not to require special highway movement permits, of gross trailer area not to exceed four hundred (400) square feet in the set-up mode, and designed to be towed by a motorized vehicle that contains a towing mechanism that is mounted above or forward of the tow vehicle’s rear axle.   • Financial loss: includes , but is not limited to, loss of earnings, out-of-pocket and other expenses, repair and replacement costs and claims payments. See Idaho Code 41-291
  • financing authority: means the entity established by the authority of this chapter, and agreements, compacts, reciprocal legislation or resolutions with or by the United States of America, the Coeur d’Alene tribe or the state of Washington to accept and invest funds and finance the activities of the basin project.   • Fingerprints: means an impression of the lines on the finger taken for purpose of identification. See Idaho Code 41-5802
  • Fireworks: means any combustible or explosive composition, or any substance or combination of substances, or article prepared for the purpose of producing a visible or audible effect by combustion, explosion, deflagration or detonation. See Idaho Code 39-2602
  • Fiscal intermediary agency: means an entity that provides services that allow the participant receiving personal assistance services, or his designee or legal representative, to choose the level of control he will assume in recruiting, selecting, managing, training and dismissing his personal assistant and over the manner in which services are delivered.   • Free medical clinic: means a facility other than a hospital or health care provider’s office which is an organized community-based program, registered with the department of health and welfare, at which primary medical care is provided without charge to individuals unable to pay for it, and at which the care provided does not include the use of general anesthesia or require an overnight stay in a health care facility.   • Full time: means a working week of a minimum of forty (40) hours at one (1) or more health care facilities. See Idaho Code 39-6105

  • Generator: means any person, who by virtue of ownership, management, or control, is responsible for causing or allowing to be caused the creation of a hazardous waste. See Idaho Code 39-4403
  • genetic test: means the testing or analysis of an identifiable individual’s DNA that results in information that is derived from the presence, absence, alteration or mutation of an inherited gene or genes, or the presence or absence of a specific DNA marker or markers. See Idaho Code 39-8302
  • Germane: On the subject of the pending bill or other business; a strict standard of relevance.
  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.

  • Hotelkeeper: means the owner, operator, management company, proprietor, keeper, manager or lessee of a hotel. See Idaho Code 39-1801
  • Household waste: means any solid waste, including garbage, trash and sanitary waste in septic tanks, derived from households, including single and multiple residences, hotels and motels, bunkhouses, ranger stations, crew quarters, campgrounds, picnic grounds and day use recreation areas.   • Idaho immunization program: means that program administered by the Idaho department of health and welfare to provide vaccinations against diseases to Idaho children consistent with Idaho and federal law. See Idaho Code 41-6002
  • Immunity: means that no civil action may arise against any person for furnishing information pursuant to section 41-248, 41-258, 41-290, 41-292, 41-296 or 41-297, Idaho Code, where actual malice on the part of the insurance company, department of insurance, state fire marshal, authorized agency, their employees or agents, is not present.   • Income: means any form of payment to an individual, regardless of source, including, but not limited to, wages, salary, commission, compensation as an independent contractor, worker’s compensation, disability, veteran’s annuity and retirement benefits, and any other payments made by any person, private entity, federal or state government, any unit of local government, school district or any entity created by a public act.   • Incompetent person: means a person who has been adjudged incompetent by an appropriate court within this state. See Idaho Code 39-302

  • Installation: means a complete conveyance including any hoistway, hoistway enclosures and related construction and all machinery and equipment for its operation. See Idaho Code 39-8603
  • Institution: means any public or private residential facility which is licensed in the state of Idaho for the purpose of providing care and treatment for individuals with developmental disabilities. See Idaho Code 39-5102
  • Institutional investor: means any of the following, whether acting for itself or for others in a fiduciary capacity:

  • Insurance: means primary insurance, excess insurance, reinsurance, surplus lines insurance, or any other arrangement for shifting and distributing risk which is determined to be insurance under this code. See Idaho Code 41-4803
  • Insurance company: means a company organized as an insurance company whose primary business is writing insurance or reinsuring risks underwritten by insurance companies and which is subject to supervision by the insurance commissioner or a similar official or agency of a state. See Idaho Code 30-14-102
  • Insurance company: means an association, corporation, fraternal or mutual benefit organization, whether or not for profit, which is engaged in providing insurance coverage, including accident, burial, casualty, credit life, contract performance, dental, fidelity, fire, health, hospitalization, illness, life, including endowments and annuities, malpractice, marine, mortgage, surety, and wage protection insurance. See Idaho Code 14-501
  • Insurance group: means those insurers and affiliates included within an insurance holding company system as that term is defined in chapter 38, title 41, Idaho Code. See Idaho Code 41-6402
  • Insurance holding company system: means two (2) or more affiliated persons, one (1) or more of whom is an insurer. See Idaho Code 41-3802
  • insured: as used in this chapter , shall not be construed as preventing a person other than the insured with a proper insurable interest from making application for and owning a policy covering the insured or from being entitled under such a policy to any indemnities, benefits, and rights provided therein. See Idaho Code 41-2130
  • Insured: means insured as to payment of all principal and all interest. See Idaho Code 30-14-102

  • Intangible property: Property that has no intrinsic value, but is merely the evidence of value such as stock certificates, bonds, and promissory notes.

  • Interested government agency: means an agency that has the authority from the United States department of state to submit requests for J-1 visa waivers of foreign physician petitioners on behalf of public interest. See Idaho Code 39-6105
  • International banking institution: means an international financial institution of which the United States is a member and whose securities are exempt from registration under the securities act of 1933. See Idaho Code 30-14-102
  • International Fire Code: means the International Fire Code as published by the International Code Council. See Idaho Code 39-4105
  • Internationally active insurance group: means an insurance holding company system that:

  • Interrogatories: Written questions asked by one party of an opposing party, who must answer them in writing under oath; a discovery device in a lawsuit.
  • Investment adviser: means a person that, for compensation, engages in the business of advising others, either directly or through publications or writings, as to the value of securities or the advisability of investing in, purchasing or selling securities or that, for compensation and as a part of a regular business, issues or promulgates analyses or reports concerning securities. See Idaho Code 30-14-102
  • Investment adviser representative: means an individual employed by or associated with an investment adviser or federal covered investment adviser who makes any recommendations or otherwise gives investment advice regarding securities, manages accounts or portfolios of clients, determines which recommendation or advice regarding securities should be given, provides investment advice or holds herself or himself out as providing investment advice, receives compensation to solicit, offer, or negotiate for the sale of or for selling investment advice, or supervises employees who perform any of the foregoing. See Idaho Code 30-14-102
  • Irrevocable trust: A trust arrangement that cannot be revoked, rescinded, or repealed by the grantor.
  • Issuer: means a bailee that issues a document of title or, in the case of an unaccepted delivery order, the person that orders the possessor of goods to deliver. See Idaho Code 28-7-102
  • Issuer: means a person that issues or proposes to issue a security, subject to the following:

  • Item: means an instrument or a promise or order to pay money handled by a bank for collection or payment. See Idaho Code 28-4-104
  • Joint meeting: An occasion, often ceremonial, when the House and Senate each adopt a unanimous consent agreement
  • Joint powers agreement: means an agreement entered into between public agencies pursuant to chapter 23, title 67, Idaho Code. See Idaho Code 41-4102
  • Joint session: When both chambers of a legislature adopt a concurrent resolution to meet together.
  • Joint tenancy: A form of property ownership in which two or more parties hold an undivided interest in the same property that was conveyed under the same instrument at the same time. A joint tenant can sell his (her) interest but not dispose of it by will. Upon the death of a joint tenant, his (her) undivided interest is distributed among the surviving joint tenants.
  • Jurisdiction of formation: means the jurisdiction whose law includes the organic law of an entity. See Idaho Code 30-21-102
  • Juror: A person who is on the jury.
  • Lake: means the Big Payette Lake and its watershed which shall include all tributaries, and small lakes on those tributaries, to the North Fork of the Payette River above Big Payette Lake. See Idaho Code 39-6602
  • Land application: means the spreading on or incorporation of animal waste into the soil mantle primarily for beneficial purposes. See Idaho Code 39-7903
  • Land application: means spreading on, or incorporating into the soil mantle, dairy byproducts as a soil amendment for agricultural use of nutrients and for other beneficial purposes. See Idaho Code 37-604
  • land application unit: means a facility that applies sludges or other solid wastes onto or incorporates solid waste into the soil surface, excluding manure spreading operations, at greater than agronomic rates and soil conditioners and immobilization rates. See Idaho Code 39-7403
  • Landfill: means an area of land or an excavation in which wastes are placed for permanent disposal, and that is not a land application unit, surface impoundment, injection well or waste pile. See Idaho Code 39-7403
  • Last known address: means a description of the location of the apparent owner sufficient for the purpose of the delivery of mail. See Idaho Code 14-501
  • Late enrollee: means an eligible employee or dependent who requests enrollment in a health benefit plan of a small employer following the initial enrollment period during which the individual is entitled to enroll under the terms of the health benefit plan, provided that the initial enrollment period is a period of at least thirty (30) days. See Idaho Code 41-4703
  • Lateral expansion: means a horizontal expansion of the waste boundaries of an existing MSWLF unit. See Idaho Code 39-7403
  • Law enforcement agency: means a city police department, the prosecuting attorney of any county, state law enforcement officers, or the office of a sheriff of any county. See Idaho Code 16-1602
  • Laws: shall mean the society’s articles of incorporation, constitution and bylaws, however designated. See Idaho Code 41-3204
  • Lawsuit: A legal action started by a plaintiff against a defendant based on a complaint that the defendant failed to perform a legal duty, resulting in harm to the plaintiff.
  • Leachate: means a liquid that has passed through or emerged from solid waste and contains soluble, suspended or miscible materials removed from such waste. See Idaho Code 39-7403
  • Legal custody: means a relationship created by court order, which vests in a custodian the following rights and responsibilities:

  • Legislative session: That part of a chamber's daily session in which it considers legislative business (bills, resolutions, and actions related thereto).
  • Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
  • Liability: means legal liability for damages, including costs of defense, legal costs and fees, and other claims expenses because of injuries to other persons, damage to their property, or other damage or loss to such other persons resulting from or arising out of any business whether profit or nonprofit, trade, product, services including professional services, premises, or operations, or arising out of any activity of any state or local government, or any agency or political subdivision thereof, but does not include personal risk liability or with the exception of an employer’s legal liability with respect to its employees under the federal employers’ liability act (45 U.   • Liability insurance policy: means a policy of insurance providing coverage for all contractual obligations incurred by a motor vehicle service contract provider under the terms of a motor vehicle service contract issued or sold by the motor vehicle service contract provider;
  • (5)  "Maintenance agreement" means a contract of limited duration that provides scheduled maintenance only;
