For the purpose of this Act, unless the context clearly requires otherwise:
     (1) “Illegal drug” means (i) any substance as defined and included in the Schedules of Article II of the Illinois Controlled Substances Act, (ii) any cannabis as defined in Section 3 of the Cannabis Control Act, or (iii) any drug as defined in paragraph (b) of Section 3 of the Pharmacy Practice Act which is obtained without a prescription or otherwise in violation of the law.

Terms Used In Illinois Compiled Statutes 740 ILCS 120/2

  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • State: when applied to different parts of the United States, may be construed to include the District of Columbia and the several territories, and the words "United States" may be construed to include the said district and territories. See Illinois Compiled Statutes 5 ILCS 70/1.14

     (2) “Minor” means a person who has not attained age 18.
     (3) “Legal guardian” means a person appointed guardian, or given custody, of a minor by a circuit court of this State, but does not include a person appointed guardian, or given custody, of a minor under the Juvenile Court Act or the Juvenile Court Act of 1987.
     (4) “Parent” means any natural or adoptive parent of a minor.
     (5) “Person” means any natural person, corporation, association, partnership, or other organization.
     (6) “Prescription” means any order for drugs, written or verbal, by a physician, dentist, veterinarian, or other person authorized to prescribe drugs within the limits of his or her license, containing the following: (1) name of the patient; (2) date when prescription was given; (3) name and strength of drug prescribed; (4) quantity, directions for use, prescriber’s name, address and signature, and the United States Drug Enforcement Administration number where required, for controlled substances.
     (7) “Sale or transfer” means the actual or constructive transfer of possession of an illegal drug, with or without consideration, whether directly or through an agent.
