In a derivative action, the complaint must state with particularity:
         (1) the date and content of plaintiff‘s demand and
    
the general partners’ response to the demand; or
        (2) why demand should be excused as futile.

Terms Used In Illinois Compiled Statutes 805 ILCS 215/1004

  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Plaintiff: The person who files the complaint in a civil lawsuit.
  • State: when applied to different parts of the United States, may be construed to include the District of Columbia and the several territories, and the words "United States" may be construed to include the said district and territories. See Illinois Compiled Statutes 5 ILCS 70/1.14
