Sec. 1. (a) This chapter applies only to actions in tort brought under:
(2) this title.
(1) IC 33, including IC 33-1-1.5 before its repeal; or

- Tort: A civil wrong or breach of a duty to another person, as outlined by law. A very common tort is negligent operation of a motor vehicle that results in property damage and personal injury in an automobile accident.
(b) This chapter does not apply to small claims actions.
