Terms Used In Indiana Code > Title 3 > Article 12 - Ascertaining Results of Elections

  • Adjournment sine die: The end of a legislative session "without day." These adjournments are used to indicate the final adjournment of an annual or the two-year session of legislature.
  • Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.
  • advisory group: refers to the legislative state of emergency advisory group established by section 11 of this chapter. See Indiana Code 2-2.1-1.2-1
  • advocacy: means speaking for, pleading for, supporting, advising, espousing the rights of, or interceding on behalf of individuals with developmental disabilities, individuals with a mental illness, or individuals seeking or receiving vocational rehabilitation services before public or private agencies, organizations, institutions, or individuals serving individuals with a developmental disability or individuals with a mental illness or providing vocational rehabilitation services.   • Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
  • agency: means any state administration, agency, authority, board, bureau, commission, committee, council, department, division, institution, office, service, or other similar body of state government. See Indiana Code 12-32-1-1
  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • applicant: means a person or company from the private sector. See Indiana Code 13-20-26-0.5
  • Appraisal: A determination of property value.
  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • Arrest: Taking physical custody of a person by lawful authority.
  • Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
  • AST: as used in this chapter and IC 13-23, refers to an aboveground storage tank (as defined in section 0. See Indiana Code 13-11-2-15.3
  • Attorney: includes a counselor or other person authorized to appear and represent a party in an action or special proceeding. See Indiana Code 1-1-4-5
  • Autism: means a neurological condition as described in the most recent edition of the Diagnostic and Statistical Manual of Mental Disorders of the American Psychiatric Association. See Indiana Code 1-1-4-5
  • Bankruptcy: Refers to statutes and judicial proceedings involving persons or businesses that cannot pay their debts and seek the assistance of the court in getting a fresh start. Under the protection of the bankruptcy court, debtors may discharge their debts, perhaps by paying a portion of each debt. Bankruptcy judges preside over these proceedings.
  • basin: refers to the Kankakee River basin and the Yellow River basin. See Indiana Code 14-13-9-1
  • Bench trial: Trial without a jury in which a judge decides the facts.
  • Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC
  • Bequest: Property gifted by will.
  • board: refers to the environmental rules board established by section 3 of this chapter. See Indiana Code 13-13-8-1
  • board of commissioners of a county: includes a person delegated by the board under section 7 of this chapter to the extent of the authority delegated by the board to the person for purposes of this article. See Indiana Code 12-30-1-0.5
  • body: refers to either of the following:

  • bureau: refers to the child support bureau (Title IV-D agency) established under IC 31-25-3. See Indiana Code 14-11-3-0.3
  • Burns Waterway: means the dredged channel in Porter County, Indiana, that connects the east and west arms of the Little Calumet River with Lake Michigan. See Indiana Code 14-13-2-1
  • Caucus: From the Algonquian Indian language, a caucus meant "to meet together." An informal organization of members of the legislature that exists to discuss issues of mutual concern and possibly to perform legislative research and policy planning for its members. There are regional, political or ideological, ethnic, and economic-based caucuses.
  • Claimant: as used in this chapter , IC 13-23-8, and IC 13-23-9, refers to a person that makes an ELTF claim. See Indiana Code 13-11-2-25.7
  • Clerk: means the clerk of the court or a person authorized to perform the clerk's duties. See Indiana Code 1-1-4-5
  • commission: refers to the Indiana protection and advocacy services commission established by this chapter. See Indiana Code 12-28-1-3
  • commission: refers to the Little Calumet River basin development commission created by this chapter. See Indiana Code 14-13-2-2
  • commission: refers to the river marina development commission. See Indiana Code 14-13-4-1
  • commission: refers to the Ohio River greenway development commission established by this chapter. See Indiana Code 14-13-5-1
  • commission: refers to the Wabash River heritage corridor commission established by this chapter. See Indiana Code 14-13-6-2
  • commission: refers to the Kankakee River basin and Yellow River basin development commission established by this chapter. See Indiana Code 14-13-9-2
  • Committee membership: Legislators are assigned to specific committees by their party. Seniority, regional balance, and political philosophy are the most prominent factors in the committee assignment process.
  • Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action.
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Confidential: means information which has been so designated by statute or by promulgated rule or regulation based on statutory authority. See Indiana Code 4-1-6-1
  • construction activities: include clearing, grading, and excavating. See Indiana Code 13-18-27-2
  • construction plan: means a written plan that:

  • Contract: A legal written agreement that becomes binding when signed.
  • contracting county: means a county that contracts with the county having a health center for the care of patients afflicted with tuberculosis or other chronic diseases. See Indiana Code 12-30-7-2
  • Conviction: A judgement of guilt against a criminal defendant.
  • corporation: means the following:

  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • corridor: means the strip of land in Indiana abutting the Ohio River and the immediate tributaries of the Ohio River. See Indiana Code 14-13-4-2
  • corridor: means the land:

  • corridor: refers to the Wabash River heritage corridor. See Indiana Code 14-13-6-3
  • Counterclaim: A claim that a defendant makes against a plaintiff.
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Data subject: means an individual about whom personal information is indexed or may be located under the individual's name, personal number, or other identifiable particulars, in a personal information system. See Indiana Code 4-1-6-1
  • Deed: The legal instrument used to transfer title in real property from one person to another.
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • department: refers to the department of natural resources. See Indiana Code 14-9-9-1
  • Devise: To gift property by will.
  • Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
  • Dismissal: The dropping of a case by the judge without further consideration or hearing. Source:
  • division: refers to the law enforcement division. See Indiana Code 14-9-8-2
  • Docket: A log containing brief entries of court proceedings.
  • Donor: The person who makes a gift.
  • drug: means :

  • East Chicago area of special concern: means all areas of East Chicago in which:

  • election officer: means a person employed or appointed by the state, a political subdivision, or a political party to perform a duty under this title. See Indiana Code 3-12-1-1.5
  • Electronic funds transfer: The transfer of money between accounts by consumer electronic systems-such as automated teller machines (ATMs) and electronic payment of bills-rather than by check or cash. (Wire transfers, checks, drafts, and paper instruments do not fall into this category.) Source: OCC
  • ELTF claim: as used in this chapter and IC 13-23, means any claim for payment from the ELTF. See Indiana Code 13-11-2-63.6
  • Entitlement: A Federal program or provision of law that requires payments to any person or unit of government that meets the eligibility criteria established by law. Entitlements constitute a binding obligation on the part of the Federal Government, and eligible recipients have legal recourse if the obligation is not fulfilled. Social Security and veterans' compensation and pensions are examples of entitlement programs.
  • EPA: refers to the United States Environmental Protection Agency. See Indiana Code 13-19-7-2
  • Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. For example, a trial by jury is normally available in "law" cases but not in "equity" cases. Source: U.S. Courts
  • erosion: means the detachment and movement of soil, sediment, or rock fragments by water, wind, ice, or gravity. See Indiana Code 13-18-27-4
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Ex officio: Literally, by virtue of one's office.
  • Executor: A male person named in a will to carry out the decedent
  • Fair market value: The price at which an asset would change hands in a transaction between a willing, informed buyer and a willing, informed seller.
  • federal public benefit: has the meaning set forth in 8 U. See Indiana Code 12-32-1-2
  • Fee simple: Absolute title to property with no limitations or restrictions regarding the person who may inherit it.
  • Fiduciary: A trustee, executor, or administrator.
  • final day of session: means :

  • fiscal body: has the meaning set forth in IC 36-1-2-6(1) or IC 36-1-2-6(2), whichever applies. See Indiana Code 14-9-9-2
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Forbearance: A means of handling a delinquent loan. A
  • Foreclosure: A legal process in which property that is collateral or security for a loan may be sold to help repay the loan when the loan is in default. Source: OCC
  • Fraud: Intentional deception resulting in injury to another.
  • fund: refers to the county health center fund established by this chapter. See Indiana Code 12-30-7-3
  • fund: refers to the revolving fund of a division. See Indiana Code 14-9-5-1
  • fund: refers to the counties with special boat patrol needs fund established by section 5 of this chapter. See Indiana Code 14-9-9-3
  • fund: refers to the Indiana natural resources fund established by this chapter. See Indiana Code 14-12-1-1

  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.

  • Grand jury: agreement providing that a lender will delay exercising its rights (in the case of a mortgage,
  • Grantor: The person who establishes a trust and places property into it.
  • Guarantor: A party who agrees to be responsible for the payment of another party's debts should that party default. Source: OCC
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Highway: includes county bridges and state and county roads, unless otherwise expressly provided. See Indiana Code 1-1-4-5
  • IHCDA: refers to the Indiana housing and community development authority created by IC 5-20-1-3. See Indiana Code 13-19-7-3
  • in writing: include printing, lithographing, or other mode of representing words and letters. See Indiana Code 1-1-4-5
  • incorrect outcome: means an outcome that is inconsistent with an election outcome that would be obtained by conducting a full recount. See Indiana Code 3-12-13-2
  • Indemnification: In general, a collateral contract or assurance under which one person agrees to secure another person against either anticipated financial losses or potential adverse legal consequences. Source: FDIC
  • Indictment: The formal charge issued by a grand jury stating that there is enough evidence that the defendant committed the crime to justify having a trial; it is used primarily for felonies.
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Interest rate: The amount paid by a borrower to a lender in exchange for the use of the lender's money for a certain period of time. Interest is paid on loans or on debt instruments, such as notes or bonds, either at regular intervals or as part of a lump sum payment when the issue matures. Source: OCC
  • Joint meeting: An occasion, often ceremonial, when the House and Senate each adopt a unanimous consent agreement
  • Joint session: When both chambers of a legislature adopt a concurrent resolution to meet together.
  • Judgment: means all final orders, decrees, and determinations in an action and all orders upon which executions may issue. See Indiana Code 1-1-4-5
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Kankakee River basin: means the following areas drained by the Kankakee River and the tributaries of the Kankakee River:

  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • Legacy: A gift of property made by will.
  • legislative council: refers to the legislative council created under Ind. See Indiana Code 2-2.1-1.2-3
  • Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
  • license: means a permit, a license, a concession, or other authorization that may be issued to a person by:

  • Lien: A claim against real or personal property in satisfaction of a debt.
  • Life estate: A property interest limited in duration to the life of the individual holding the interest (life tenant).
  • Litigation: A case, controversy, or lawsuit. Participants (plaintiffs and defendants) in lawsuits are called litigants.
  • member: refers to either of the following:

  • minor: means a person less than eighteen (18) years of age. See Indiana Code 1-1-4-5
  • Month: means a calendar month, unless otherwise expressed. See Indiana Code 1-1-4-5
  • Mortgage: The written agreement pledging property to a creditor as collateral for a loan.
  • municipal corporation: has the meaning set forth in IC 36-1-2. See Indiana Code 14-12-3-3

  • Nolo contendere: No contest-has the same effect as a plea of guilty, as far as the criminal sentence is concerned, but may not be considered as an admission of guilt for any other purpose.

  • Oath: A promise to tell the truth.
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.

  • Oversight: Committee review of the activities of a Federal agency or program.
  • parcel: refers to a particular parcel identified by a unique parcel number as described in 50 IAC 26-2-31. See Indiana Code 14-13-2-3.3
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • person: means an individual, a partnership, an association, a limited liability company, a corporation, an estate, a trust, or a governmental entity. See Indiana Code 14-12-2-3
  • personal care product: means :

  • Personal information: means any information that describes, locates, or indexes anything about an individual or that affords a basis for inferring personal characteristics about an individual including, but not limited to, the individual's education, financial transactions, medical history, criminal or employment records, finger and voice prints, photographs, or the individual's presence, registration, or membership in an organization or activity or admission to an institution. See Indiana Code 4-1-6-1
  • Personal information system: means any recordkeeping process, whether automated or manual, containing personal information and the name, personal number, or other identifying particulars of a data subject. See Indiana Code 4-1-6-1
  • Personal property: includes goods, chattels, evidences of debt, and things in action. See Indiana Code 1-1-4-5
  • Personal property: All property that is not real property.
  • petitioner: refers to the individual voter whose name is listed first on the petition filed under section 2 of this chapter. See Indiana Code 3-12-12-1.7
  • Plaintiff: The person who files the complaint in a civil lawsuit.
  • plastic: means a synthetic material made from linking monomers through a chemical reaction to create an organic polymer chain that may be molded or extruded at high heat into various solid forms that retain the defined shapes of the solid forms:

  • Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
  • political subdivision: has the meaning set forth in IC 36-1-2-13. See Indiana Code 14-12-1-2
  • political subdivision: shall mean any county, township, city, and town. See Indiana Code 4-1-4-1
  • Population: has the meaning set forth in Ind. See Indiana Code 1-1-4-5
  • post-election audit: means an audit protocol that makes use of statistical methods and is designed to limit to acceptable levels the risk of certifying a preliminary election outcome that constitutes an incorrect outcome. See Indiana Code 3-12-13-3
  • Precedent: A court decision in an earlier case with facts and law similar to a dispute currently before a court. Precedent will ordinarily govern the decision of a later similar case, unless a party can show that it was wrongly decided or that it differed in some significant way.
  • Presiding officer: A majority-party Senator who presides over the Senate and is charged with maintaining order and decorum, recognizing Members to speak, and interpreting the Senate's rules, practices and precedents.
  • prior natural resources law: refers to the statutes that are repealed or amended in the recodification act of the 1995 regular session of the general assembly as the statutes existed before the effective date of the applicable or corresponding provision of the recodification act of the 1995 regular session of the general assembly. See Indiana Code 14-8-3-1
  • Probable cause: A reasonable ground for belief that the offender violated a specific law.
  • Probate: Proving a will
  • Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
  • procedure audit: refers to a process by which the procedures of an election are reviewed to determine how well an election was conducted in accordance with Indiana law. See Indiana Code 3-12-14-2
  • program: refers to the hometown Indiana grant program established by this chapter. See Indiana Code 14-12-3-4
  • program year: means a calendar year. See Indiana Code 13-20.5-1-0.5
  • project: means an undertaking that:

  • project committee: refers to the President Benjamin Harrison conservation trust project committee established by this chapter. See Indiana Code 14-12-2-5
  • project site owner: means the person required to comply with 327 IAC 15-5, the general permit, or the applicable ordinance of an MS4 community with respect to a construction project. See Indiana Code 13-18-27-9
  • Property: includes personal and real property. See Indiana Code 1-1-4-5
  • property: means an interest in real property. See Indiana Code 14-12-2-6
  • Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government.
  • Quorum: The number of legislators that must be present to do business.
  • real property: include lands, tenements, and hereditaments. See Indiana Code 1-1-4-5
  • Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
  • records: means any writing, paper, report, study, map, photograph, book, card, tape recording, or other material that is created, received, retained, maintained, or filed by or with the advisory group and which is generated on paper, paper substitutes, photographic media, chemically based media, magnetic or machine readable media, electronically stored data, or any other material, regardless of form or characteristics. See Indiana Code 2-2.1-1.2-5
  • Recourse: An arrangement in which a bank retains, in form or in substance, any credit risk directly or indirectly associated with an asset it has sold (in accordance with generally accepted accounting principles) that exceeds a pro rata share of the bank's claim on the asset. If a bank has no claim on an asset it has sold, then the retention of any credit risk is recourse. Source: FDIC
  • recyclable material: means municipal waste that is suitable for recycling. See Indiana Code 13-20-25-4
  • recyclable materials broker: means a person that:

  • recycle: means to take action by which recyclable materials are recovered from the solid waste stream for purposes of:

  • recycler: means a person who recycles recyclable materials generated by more than one (1) person. See Indiana Code 13-20-25-7
  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • Remand: When an appellate court sends a case back to a lower court for further proceedings.
  • Rescission: The cancellation of budget authority previously provided by Congress. The Impoundment Control Act of 1974 specifies that the President may propose to Congress that funds be rescinded. If both Houses have not approved a rescission proposal (by passing legislation) within 45 days of continuous session, any funds being withheld must be made available for obligation.
  • restricted rules: means the rules that the United States Secretary of Health and Human Services is restricted from implementing under the congressional moratorium enacted as part of H. See Indiana Code 12-29-4-1
  • review authority: means either of the following:

  • sedimentation: means the settling and accumulation of unconsolidated sediment carried by storm water runoff. See Indiana Code 13-18-27-11
  • Service of process: The service of writs or summonses to the appropriate party.
  • services: refers to Indiana protection and advocacy services. See Indiana Code 12-28-1-4
  • Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
  • Sheriff: means the sheriff of the county or another person authorized to perform sheriff's duties. See Indiana Code 1-1-4-5
  • small construction activity site: means :

  • small lake: means a body of public water having a surface area that does not exceed three hundred (300) acres, excluding the following in determining the surface area:

  • State agency: means every agency, board, commission, department, bureau, or other entity of the administrative branch of Indiana state government, except those which are the responsibility of the auditor of state, treasurer of state, secretary of state, attorney general, and excepting the department of state police and state educational institutions.   • state of emergency: refers to an emergency declared by the governor under Ind. See Indiana Code 2-2.1-1.2-6
  • state or local public benefit: has the meaning set forth in 8 U. See Indiana Code 12-32-1-3
  • Statute: A law passed by a legislature.
  • Subpoena: A command to a witness to appear and give testimony.
  • Summons: Another word for subpoena used by the criminal justice system.
  • taxable parcel: refers to a parcel that is not exempt from property taxation under Indiana Code 14-13-2-3.5
  • taxable parcel: refers to a parcel that is not exempt from property taxation under Indiana Code 14-13-9-4
  • Testify: Answer questions in court.
  • Testimony: Evidence presented orally by witnesses during trials or before grand juries.
  • trained individual: means an individual who is trained and experienced in the principles of storm water management, including erosion and sediment control, as demonstrated by:
