Terms Used In Kansas Statutes 41-323

  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.

Any action of the secretary pursuant to Kan. Stat. Ann. § 41-321, and amendments thereto, is subject to review in accordance with the Kansas judicial review act. At the time of the filing of the petition for review, the petitioner shall give a bond for costs conditioned on the petitioner’s prosecuting the appeal without delay and paying all costs assessed against the petitioner. If review of the decision of the district court is sought pursuant to Kan. Stat. Ann. § 77-623, and amendments thereto, the director shall not be required to give a bond on such review.
