Terms Used In Kansas Statutes 65-4902

  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • health care provider: means a health care provider as that term is defined by Kan. See Kansas Statutes 65-4941
  • Plaintiff: The person who files the complaint in a civil lawsuit.

The judge of the district court shall notify the parties to the action that a screening panel has been convened. The plaintiff or claimant and the defendant or respondent shall each designate a health care provider licensed in the same profession as the defendant or respondent within 21 days of such party’s receipt of notice of the convening of the screening panel. The parties shall jointly designate a health care provider licensed in the same profession as the defendant or respondent within 14 days after the individual designations have been made. If the parties are unable to jointly select a health care provider within such 14 days, the judge of the district court shall select such health care provider.
