Terms Used In Kansas Statutes 76-12b07

  • Guardian: means an individual or a nonprofit corporation certified in accordance with Kan. See Kansas Statutes 77-201
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Institution: means a state institution for people with intellectual disability including the following institutions: Kansas neurological institute and Parsons state hospital. See Kansas Statutes 76-12b01
  • Intellectual disability: means significantly subaverage general intellectual functioning existing concurrently with deficits in adaptive behavior. See Kansas Statutes 76-12b01
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Secretary: means the secretary for aging and disability services or the designee of the secretary. See Kansas Statutes 76-12b01

The secretary may transfer a person from one institution to another institution whenever the secretary is of the opinion that the transfer is in the best interests of the person. The secretary may transfer temporarily a person to any other institution under the jurisdiction of the secretary for a period not to exceed 90 days to obtain treatment not available in an institution for people with intellectual disability. The secretary shall consult with the person, natural guardian or guardian prior to any transfer under this section.
