Terms Used In Kansas Statutes 8-2811

  • Peer-to-peer vehicle sharing: means the authorized use of a shared vehicle by an individual other than the shared vehicle's owner through a peer-to-peer vehicle sharing program. See Kansas Statutes 8-2802
  • Peer-to-peer vehicle sharing program: means a business platform that connects vehicle owners with drivers to enable the sharing of vehicles for financial consideration. See Kansas Statutes 8-2802
  • Residence: means the place which is adopted by a person as the person's place of habitation and to which, whenever the person is absent, the person has the intention of returning. See Kansas Statutes 77-201
  • Shared vehicle: means a vehicle that is available for sharing through a peer-to-peer vehicle sharing program. See Kansas Statutes 8-2802
  • Shared vehicle driver: means an individual who has been authorized to drive the shared vehicle by the shared vehicle owner under a vehicle sharing program agreement. See Kansas Statutes 8-2802
  • State: when applied to the different parts of the United States, includes the District of Columbia and the territories. See Kansas Statutes 77-201

(a) A peer-to-peer vehicle sharing program shall not enter into a peer-to-peer vehicle sharing program agreement with a driver unless the driver who will operate the shared vehicle:

(1) Holds a driver’s license issued by the state of Kansas that authorizes the driver to operate vehicles of the class of the shared vehicle;

(2) is a nonresident who:

(A) Has a driver’s license issued by the state or country of the driver’s residence that authorizes the driver in that state or country to drive vehicles of the class of the shared vehicle; and

(B) is at least the legal age required of a resident to drive in the state of Kansas; or

(3) otherwise is specifically authorized by the state of Kansas to drive vehicles of the class of the shared vehicle.

(b) A peer-to-peer vehicle sharing program shall maintain a record of the name, address, driver’s license number and place of issuance of the driver’s license of the shared vehicle driver and every other person, if any, who will also drive the shared vehicle.
