Terms Used In Louisiana Code of Criminal Procedure 342

  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.

After the delay for filing a suspensive appeal has elapsed or when a judgment becomes final and definitive, the prosecuting attorney may file a rule to show cause in accordance with La. Rev. Stat. 22:1441 or collect the judgment in the same manner as a civil judgment.
