Terms Used In Louisiana Code of Civil Procedure 821

  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Appellate: About appeals; an appellate court has the power to review the judgement of another lower court or tribunal.

Articles 801 through 807 govern the substitution of parties in a case pending in a district court on appeal from a justice of the peace or city court.

The substitution of parties in an action pending in the supreme court or in a court of appeal is governed by the rules of the appellate court.
