Terms Used In Louisiana Revised Statutes 37:2406

A.  There shall be no liability on the part of and no action for damages against:

(1)  Any member of the board, its agents, employees, attorneys, or any member of a committee appointed or designated by the board, for any action undertaken or performed by such person within the scope of the duties, powers, and functions of the board or such committee when such person is acting without malice and in the reasonable belief that the action taken by him is warranted.

(2)  Any person or health care entity providing information or reports to the board, its agents or employees, or to a committee appointed or designated by the board, without malice and in the reasonable belief that such information is accurate, including information or reports required by the provisions of La. Rev. Stat. 37:1745.14.  Such immunity from liability shall additionally be in accordance with the provisions of La. Rev. Stat. 37:1745.16.

B.  Information or reports concerning or relating to improper conduct by or the impairment of a licensed physical therapist or physical therapist assistant provided to the board or gathered by the board through investigation, including in compliance with the provisions of La. Rev. Stat. 37:1745.14, shall be, in accordance with the provisions of La. Rev. Stat. 37:1745.15, confidential.
