  • Adult: means a person who has attained the age of 18 years. See Maine Revised Statutes Title 15 Sec. 225
  • Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC
  • CODIS: means the Federal Bureau of Investigation's national DNA identification index system that allows for storage and exchange of DNA records submitted by state and local forensic DNA laboratories and is derived from the Combined DNA Index System. See Maine Revised Statutes Title 25 Sec. 1572
  • Continuing care: means furnishing shelter for the life of the individual or for a period in excess of one year and either health care, supportive services, or both, under an agreement requiring prepayment as defined in subsection 12, whether or not the shelter and services are provided at the same location, to 3 or more older individuals not related by blood or marriage to the providers. See Maine Revised Statutes Title 25 Sec. 1535
  • Continuing care agreement: means the contract or contracts which create the obligation to provide continuing care, including, but not limited to, mutually terminable contracts. See Maine Revised Statutes Title 25 Sec. 1535
  • Contract: A legal written agreement that becomes binding when signed.
  • Conviction: A judgement of guilt against a criminal defendant.
  • Crime lab: means the Maine State Police Crime Laboratory located in Augusta. See Maine Revised Statutes Title 25 Sec. 1572
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Department: means the Department of Health and Human Services. See Maine Revised Statutes Title 25 Sec. 1535
  • Dismissal: The dropping of a case by the judge without further consideration or hearing. Source:
  • DNA: means deoxyribonucleic acid. See Maine Revised Statutes Title 25 Sec. 1572
  • DNA analysis: means DNA typing tests that derive identification information specific to a person from that person's DNA. See Maine Revised Statutes Title 25 Sec. 1572
  • DNA record: means DNA identification information obtained from DNA analysis and stored in the state DNA data base or CODIS. See Maine Revised Statutes Title 25 Sec. 1572
  • DNA sample: means a biological sample provided by a person convicted or a juvenile adjudicated of one of the offenses listed in this chapter or submitted to the crime lab for analysis pursuant to a criminal investigation. See Maine Revised Statutes Title 25 Sec. 1572
  • Entrance fee: means an initial payment of a sum of money or any other consideration that assures a subscriber a place in a facility for a term of years or for life. See Maine Revised Statutes Title 25 Sec. 1535
  • Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. For example, a trial by jury is normally available in "law" cases but not in "equity" cases. Source: U.S. Courts
  • Escrow: Money given to a third party to be held for payment until certain conditions are met.
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Facility: means a physical plant in which continuing care is provided in accordance with this chapter. See Maine Revised Statutes Title 25 Sec. 1535
  • FBI: means the Federal Bureau of Investigation of the United States Department of Justice. See Maine Revised Statutes Title 25 Sec. 1572
  • Felony: A crime carrying a penalty of more than a year in prison.
  • in writing: include printing and other modes of making legible words. See Maine Revised Statutes Title 15 Sec. 225
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Juvenile: means any person who has not attained 18 years of age. See Maine Revised Statutes Title 25 Sec. 1572
  • Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
  • Month: means a calendar month. See Maine Revised Statutes Title 15 Sec. 225
  • Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
  • Provider: means the owner of an institution, building, residence or other place, whether operated for profit or not, in which the owner undertakes to provide continuing care. See Maine Revised Statutes Title 25 Sec. 1535
  • Real estate: includes lands and all tenements and hereditaments connected therewith, and all rights thereto and interests therein. See Maine Revised Statutes Title 15 Sec. 225
  • Rescission: The cancellation of budget authority previously provided by Congress. The Impoundment Control Act of 1974 specifies that the President may propose to Congress that funds be rescinded. If both Houses have not approved a rescission proposal (by passing legislation) within 45 days of continuous session, any funds being withheld must be made available for obligation.
  • Residential unit: means an apartment, room or other area within a facility set aside for the exclusive and independent living use of one or more identified subscribers. See Maine Revised Statutes Title 25 Sec. 1535
  • State DNA data bank: means the repository of DNA samples maintained by the Chief of the State Police at the crime lab collected pursuant to this chapter. See Maine Revised Statutes Title 25 Sec. 1572
  • State DNA data base: means the DNA identification record system administered by the Chief of the State Police. See Maine Revised Statutes Title 25 Sec. 1572
  • Subscriber: means a purchaser or beneficiary of a continuing care agreement. See Maine Revised Statutes Title 25 Sec. 1535
  • Superintendent: means the Superintendent of Insurance. See Maine Revised Statutes Title 25 Sec. 1535
  • Temporary restraining order: Prohibits a person from an action that is likely to cause irreparable harm. This differs from an injunction in that it may be granted immediately, without notice to the opposing party, and without a hearing. It is intended to last only until a hearing can be held.
  • United States: includes territories and the District of Columbia. See Maine Revised Statutes Title 15 Sec. 225
  • Year: means a calendar year, unless otherwise expressed. See Maine Revised Statutes Title 15 Sec. 225
