  • Accessory equipment: means equipment, materials and controls that are not integral parts of the oil, solid fuel, propane or natural gas burning unit but that are connected to the oil, solid fuel, propane or natural gas burning unit and have the potential to affect the safety of the equipment.   • Accredited: means an educational institution that is approved by the United States Department of Education, or one of its regionally accredited agencies. See Maine Revised Statutes Title 32 Sec. 17101
  • Active duty military: means full-time duty status in the active uniformed service of the United States, including members of the National Guard and Reserve on active duty orders pursuant to 10 United States Code, Chapter 1209 and 10 United States Code, Chapter 1211.   • Adult: means a person who has attained the age of 18 years. See Maine Revised Statutes Title 1 Sec. 72
  • Adverse action: means any administrative, civil, equitable or criminal action permitted by a state's laws that is imposed by a licensing board or other authority against an audiologist or speech-language pathologist, including actions against an individual's license or privilege to practice such as revocation, suspension, probation, monitoring of the licensee or restriction on the licensee's practice.   • Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
  • Alternative program: means a nondisciplinary monitoring process approved by an audiology or speech-language pathology licensing board to address impaired practitioners. See Maine Revised Statutes Title 32 Sec. 17502
  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Animal: means every living, sentient creature not a human being. See Maine Revised Statutes Title 7 Sec. 3907
  • Animal control: means control of dogs, cats, and domesticated or undomesticated animals in accordance with section 3948. See Maine Revised Statutes Title 7 Sec. 3907
  • Animal control officer: means the person appointed periodically by a municipality pursuant to chapter 725. See Maine Revised Statutes Title 7 Sec. 3907

  • Asynchronous encounter: means an interaction between a patient and a person licensed under this chapter through a system that has the ability to store digital information, including, but not limited to, still images, video files, audio files, text files and other relevant data, and to transmit such information without requiring the simultaneous presence of the patient and the person licensed under this chapter.   • At large: means off the premises of the owner and not under the control of any person whose personal presence and attention would reasonably control the conduct of the animal. See Maine Revised Statutes Title 7 Sec. 3907
  • Audiologist: means an individual who is licensed by a state to practice audiology. See Maine Revised Statutes Title 32 Sec. 17502
  • Audiologist: means an individual who is licensed under this chapter and practices audiology and who by virtue of academic and practical training presents that person to the public by the title or description of services incorporating the words audiologist, hearing clinician, hearing therapist or a similar title or description of service.   • Audiology: means the care and services provided by a licensed audiologist as set forth in the member state's statutes and rules. See Maine Revised Statutes Title 32 Sec. 17502
  • Audiology: means the application of theories, principles and procedures related to hearing and balance disorders for the purposes of assessment and treatment. See Maine Revised Statutes Title 32 Sec. 17101

  • Boarding kennel: means any place, building, tract of land or abode in or on which 3 or more privately owned companion animals are kept at any one time for their owners in return for a fee or compensation and includes a facility where 3 or more companion animals are kept for training purposes for compensation.   • Breeding kennel: means a location where 5 or more adult female dogs or cats capable of breeding are kept and some or all of the offspring are offered for sale, sold or exchanged for value or a location where more than 16 dogs or cats raised on the premises are sold to the public in a 12-month period.   • Business day: means any day of the calendar year other than a Saturday, Sunday or legal holiday. See Maine Revised Statutes Title 7 Sec. 3907
  • Calibration: means the objective adjustment of a machine to an accepted standard. See Maine Revised Statutes Title 32 Sec. 17101
  • Cat: means a member of the genus and species known as Felis catus. See Maine Revised Statutes Title 7 Sec. 3907
  • Chimney: means a factory-built, masonry or metal chimney constructed to allow one or more vertical or nearly vertical passageways for conveying flue gases from a building to the outside atmosphere. See Maine Revised Statutes Title 32 Sec. 18101
  • Client: means a recipient of audiology or speech-language pathology services. See Maine Revised Statutes Title 32 Sec. 17502
  • Code of ethics: means the code of ethics pertaining to the practices of speech-language pathology, audiology and hearing aid dealing and fitting adopted by the board. See Maine Revised Statutes Title 32 Sec. 17101
  • commission: means the national administrative body whose membership consists of all states that have enacted the compact. See Maine Revised Statutes Title 32 Sec. 17502
  • Commissioner: means the Commissioner of Professional and Financial Regulation. See Maine Revised Statutes Title 32 Sec. 17101
  • Compact privilege: means the authorization granted by a remote state to allow a licensee from another member state to practice as an audiologist or speech-language pathologist in the remote state under its laws and rules. See Maine Revised Statutes Title 32 Sec. 17502
  • Continuance: Putting off of a hearing ot trial until a later time.
  • Conversion therapy: means any practice or treatment that seeks or claims to change an individual's sexual orientation or gender identity, including, but not limited to, any effort to change gender expression or to eliminate or reduce sexual or romantic attractions, feelings or behavior toward others based on the individual's gender.   • Current significant investigative information: means investigative information that a licensing board, after an inquiry or investigation that includes notification and an opportunity for the audiologist or speech-language pathologist to respond, if required by state law, has reason to believe is not groundless and, if proved true, would indicate more than a minor infraction.   • Data system: means a repository of information about licensees, including, but not limited to, continuing education, examination, licensure, investigative, compact privilege and adverse action. See Maine Revised Statutes Title 32 Sec. 17502
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.

  • Dispensing station: means a licensed facility consisting of fixed equipment where propane or natural gas is stored and dispensed into portable containers. See Maine Revised Statutes Title 32 Sec. 18101
  • Dog: means a member of the genus and species known as canis familiaris, except that in chapters 720, 721, 725, 727, 729 and 739 "dog" means a member of the genus and species known as canis familiaris or any canine, regardless of generation, resulting from the interbreeding of a member of canis familiaris with a wolf hybrid.   • Equipment installations: means the installation, alteration or repair of oil, solid fuel, propane or natural gas burning equipment and chimneys, or pellet-fired central heating appliances, including accessory equipment as relating only to the safety of the installation.   • Ex officio: Literally, by virtue of one's office.

  • Hearing aid: means a wearable instrument or device designed for or offered for the purpose of aiding or compensating for impaired human hearing and any parts, attachments or accessories, including ear molds, but excluding batteries and cords. See Maine Revised Statutes Title 32 Sec. 17101
  • Hearing aid dealer and fitter: means an individual licensed under this chapter who engages in the practice of dealing in and fitting of hearing aids. See Maine Revised Statutes Title 32 Sec. 17101
  • Home state: means the member state that is the licensee's primary state of residence. See Maine Revised Statutes Title 32 Sec. 17502
  • Humane agent: means an employee of the department who assists in enforcing this Part. See Maine Revised Statutes Title 7 Sec. 3907
  • Impaired practitioner: means an individual whose professional practice is adversely affected by substance use disorder, addiction or other health-related conditions. See Maine Revised Statutes Title 32 Sec. 17502
  • Indemnification: In general, a collateral contract or assurance under which one person agrees to secure another person against either anticipated financial losses or potential adverse legal consequences. Source: FDIC
  • Indictment: The formal charge issued by a grand jury stating that there is enough evidence that the defendant committed the crime to justify having a trial; it is used primarily for felonies.
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Keeper: means a person in possession or control of a dog or other animal. See Maine Revised Statutes Title 7 Sec. 3907
  • Kennel: means 5 or more dogs kept in a single location under one ownership for breeding, hunting, show, training, field trials, sledding, competition or exhibition purposes. See Maine Revised Statutes Title 7 Sec. 3907
  • Licensee: means an individual who currently holds an authorization from the state licensing board to practice as an audiologist or speech-language pathologist. See Maine Revised Statutes Title 32 Sec. 17502
  • licensing board: means the agency of a state that is responsible for the licensing and regulation of audiologists and speech-language pathologists. See Maine Revised Statutes Title 32 Sec. 17502

  • Mortgage: The written agreement pledging property to a creditor as collateral for a loan.
  • Municipality: means an organized city, town or plantation. See Maine Revised Statutes Title 7 Sec. 3907
  • Natural gas: means hydrocarbon fuel in a gaseous state with a composition of predominantly CH4. See Maine Revised Statutes Title 32 Sec. 18101
  • NFPA: means the National Fire Protection Association. See Maine Revised Statutes Title 32 Sec. 18101
  • Owner: means a person owning, keeping or harboring a dog or other animal. See Maine Revised Statutes Title 7 Sec. 3907
  • Person: means an individual, corporation, partnership, association or any other legal entity. See Maine Revised Statutes Title 7 Sec. 3907
  • Pet: means a dog, cat or other domesticated animal commonly kept as a companion, but does not include tamed animals that are ordinarily considered wild animals or livestock. See Maine Revised Statutes Title 7 Sec. 3907
  • Pet shop: means a place or vehicle in or on which any dogs, cats, rodents, reptiles, fish, pet birds, exotic birds or exotic animals not born and raised on those premises are kept for the purpose of sale to the public. See Maine Revised Statutes Title 7 Sec. 3907
  • Plaintiff: The person who files the complaint in a civil lawsuit.
  • Practice of dealing in and fitting of hearing aids: means , but is not limited to, the selection, adaptation or sale of hearing aids, or parts of hearing aids; the testing of hearing by means of an audiometer or equivalent measurement of hearing; the making of impressions for ear molds; and hearing aid orientation that includes instruction in use and care of the instrument, information regarding expectations and limitations, information regarding the availability of additional services to meet associated needs, auditory rehabilitation, communication therapy and additional special counseling services and information regarding follow-up services, malfunctioning of hearing aids, mechanical adjustment or repair or remakes of hearing aids or ear molds. See Maine Revised Statutes Title 32 Sec. 17101
  • Privilege to practice: means a legal authorization permitting the practice of audiology or speech-language pathology in a remote state. See Maine Revised Statutes Title 32 Sec. 17502
  • Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
  • Propane: means a hydrocarbon fuel with a chemical composition of predominantly C3H8, whether recovered from natural gas or from crude oil. See Maine Revised Statutes Title 32 Sec. 18101
  • Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government.
  • Public law: A public bill or joint resolution that has passed both chambers and been enacted into law. Public laws have general applicability nationwide.
  • Remote state: means a member state other than the home state where a licensee is exercising or seeking to exercise the compact privilege. See Maine Revised Statutes Title 32 Sec. 17502
  • Respective municipality: means , in the case of towns, plantations and cities, the municipality where the dog or ferret is found; in the case of unorganized territories, the municipality near or adjacent to the unorganized territory where the dog or ferret is found; or the designee of that municipality.   • Rule: means a regulation, principle or directive promulgated by the commission that has the force of law. See Maine Revised Statutes Title 32 Sec. 17502
  • sale: means a transfer of title or of the right to use by lease, bailment or any other contract, between a licensed hearing aid dealer and fitter or a licensed audiologist and a purchaser, but does not include wholesale transactions. See Maine Revised Statutes Title 32 Sec. 17101
  • Security deposit: means any advance or deposit, regardless of its denomination, of money, the primary function of which is to secure the performance of a lease or tenancy at will agreement for residential premises or any part thereof. See Maine Revised Statutes Title 14 Sec. 6031
  • Self-service dispensing station: means a licensed facility where propane or natural gas is dispensed into permanently mounted fuel containers on vehicles. See Maine Revised Statutes Title 32 Sec. 18101
  • Service of process: The service of writs or summonses to the appropriate party.

  • Solid fuel: means coal, wood, pellets and other similar organic materials or any combination of them. See Maine Revised Statutes Title 32 Sec. 18101
  • Speech-language pathologist: means an individual who is licensed by a state to practice speech-language pathology. See Maine Revised Statutes Title 32 Sec. 17502
  • Speech-language pathologist: means an individual who is licensed under this chapter and who practices speech-language pathology and who by virtue of academic and practical training presents the individual to the public by any title or description of services incorporating the words speech pathologist, speech therapist, speech correctionist, speech clinician, language pathologist, language therapist, logopedist, communicologist, voice therapist, voice pathologist or any similar title or description of service.   • Speech-language pathologist and audiologist: means an individual who is dually licensed under this chapter and who practices speech-language pathology and audiology. See Maine Revised Statutes Title 32 Sec. 17101

  • State practice laws: means a member state's laws, rules and regulations that govern the practice of audiology or speech-language pathology, define the scope of audiology or speech-language pathology practice and create the methods and grounds for imposing discipline.   • Statute: A law passed by a legislature.
  • Store and forward transfer: means the transmission of a patient's records through a secure electronic system to a person licensed under this chapter. See Maine Revised Statutes Title 32 Sec. 17401

  • Subpoena: A command to a witness to appear and give testimony.
  • Summons: Another word for subpoena used by the criminal justice system.
  • Supervision: means the direct observation of work and the assessment of written records of service by a licensed speech pathologist, licensed audiologist, licensed physician or licensed hearing aid dealer and fitter licensed under this chapter commensurate with the skills of the individual as determined by the supervisor.   • Synchronous encounter: means a real-time interaction conducted with an interactive audio or video connection between a patient and a person licensed under this chapter or between a person licensed under this chapter and another health care provider. See Maine Revised Statutes Title 32 Sec. 17401
  • Telehealth: means the application of telecommunications technology to deliver audiology or speech-language pathology services at a distance for assessment, intervention or consultation. See Maine Revised Statutes Title 32 Sec. 17502
  • Telehealth services: means health care services delivered through the use of information technology and includes synchronous encounters, asynchronous encounters, store and forward transfers and telemonitoring. See Maine Revised Statutes Title 32 Sec. 17401
  • Telemonitoring: means the use of information technology to remotely monitor a patient's health status via electronic means, allowing the person licensed under this chapter to track the patient's health data over time. See Maine Revised Statutes Title 32 Sec. 17401
  • Temporary license: means an individual who is licensed under this chapter and practices audiology or speech-language pathology while under supervision and training of an individual who holds a valid license in good standing in the appropriate specialty under this chapter. See Maine Revised Statutes Title 32 Sec. 17101
  • Testify: Answer questions in court.
  • Testimony: Evidence presented orally by witnesses during trials or before grand juries.
  • Trainee permit: means an individual licensed under this chapter who practices in hearing aid dealing and fitting while under supervision and training of an individual who holds a valid license in good standing to practice hearing aid dealing and fitting under this chapter.   • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
  • Venue: The geographical location in which a case is tried.
  • Victim: means an individual who has been subject to domestic violence, sexual assault or stalking. See Maine Revised Statutes Title 14 Sec. 6000
  • Wolf hybrid: includes a mammal that is represented by its owner to be a wolf hybrid, coyote hybrid, coydog or any other kind of wild canid hybrid. See Maine Revised Statutes Title 7 Sec. 3907
  • Wood pellets: means a wood fuel product manufactured from compressed sawdust or other wood by-product that is pressed or extruded into pieces of uniform size and shape that are designed to be fed in bulk to a combustion chamber. See Maine Revised Statutes Title 32 Sec. 18101
  • Writ: A formal written command, issued from the court, requiring the performance of a specific act.
