Terms Used In Michigan Laws > Chapter 484 > Act 480 of 2006 - Uniform Video Services Local Franchise Act

  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
  • Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.
  • Cable operator: means that term as defined in 47 USC 522(5). See Michigan Laws 484.3301
  • Cable service: means that term as defined in 47 USC 522(6). See Michigan Laws 484.3301
  • Cable system: means that term as defined in 47 USC 522(7). See Michigan Laws 484.3301
  • Commission: means the Michigan public service commission. See Michigan Laws 484.3301
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Contract: A legal written agreement that becomes binding when signed.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • franchise agreement: means the franchise agreement required under this act to be the operating agreement between each franchising entity and video provider in this state. See Michigan Laws 484.3301
  • Franchising entity: means the local unit of government in which a provider offers video services through a franchise. See Michigan Laws 484.3301
  • Freedom of Information Act: A federal law that mandates that all the records created and kept by federal agencies in the executive branch of government must be open for public inspection and copying. The only exceptions are those records that fall into one of nine exempted categories listed in the statute. Source: OCC
  • Household: means a house, an apartment, a mobile home, or any other structure or part of a structure intended for residential occupancy as separate living quarters. See Michigan Laws 484.3301
  • in writing: shall be construed to include printing, engraving, and lithographing; except that if the written signature of a person is required by law, the signature shall be the proper handwriting of the person or, if the person is unable to write, the person's proper mark, which may be, unless otherwise expressly prohibited by law, a clear and classifiable fingerprint of the person made with ink or another substance.   • Incumbent video provider: means a cable operator serving cable subscribers or a telecommunication provider providing video services through the provider's existing telephone exchange boundaries in a particular franchise area within a local unit of government on the effective date of this act.   • IPTV: means internet protocol television. See Michigan Laws 484.3301
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Local unit of government: means a city, village, or township. See Michigan Laws 484.3301
  • month: means a calendar month; the word "year" a calendar year; and the word "year" alone shall be equivalent to the words "year of our Lord". See Michigan Laws 8.3j
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • Oversight: Committee review of the activities of a Federal agency or program.
  • OVS: means that term as defined in 47 USC 573. See Michigan Laws 484.3301
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Person: means an individual, corporation, association, partnership, governmental entity, or any other legal entity. See Michigan Laws 484.3301
  • provider: means a person authorized under this act to provide video service. See Michigan Laws 484.3301
  • Public rights-of-way: means the area on, below, or above a public roadway, highway, street, public sidewalk, alley, waterway, or utility easements dedicated for compatible uses. See Michigan Laws 484.3301
  • Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
  • state: when applied to the different parts of the United States, shall be construed to extend to and include the District of Columbia and the several territories belonging to the United States; and the words "United States" shall be construed to include the district and territories. See Michigan Laws 8.3o
  • Testimony: Evidence presented orally by witnesses during trials or before grand juries.
  • Video programming: means that term as defined in 47 USC 522(20). See Michigan Laws 484.3301
  • Video service: means video programming, cable services, IPTV, or OVS provided through facilities located at least in part in the public rights-of-way without regard to delivery technology, including internet protocol technology. See Michigan Laws 484.3301
  • Video service provider fee: means the amount paid by a video service provider or incumbent video provider under section 6. See Michigan Laws 484.3301
