In any case involving an application from the child’s parent, parents or legal guardian, the child must first be examined and evaluated by the administrative officer or the staff of the administrative officer and admitted to a treatment facility only if, in the judgment of the administrative officer:

- Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
1. The child can benefit from the program of treatment; and
2. Facilities and staff are available and adequate to meet the child’s needs.
