I. The committee shall evaluate and accept or reject sites proposed by a landowner pursuant to N.H. Rev. Stat. § 432:22. The committee shall consider in their evaluation, at a minimum, the following:
(a) The degree to which the acquisition would serve to preserve the agricultural potential of the state;

  • Fair market value: The price at which an asset would change hands in a transaction between a willing, informed buyer and a willing, informed seller.
  • following: when used by way of reference to any section of these laws, shall mean the section next preceding or following that in which such reference is made, unless some other is expressly designated. See New Hampshire Revised Statutes 21:13
  • state: when applied to different parts of the United States, may extend to and include the District of Columbia and the several territories, so called; and the words "United States" shall include said district and territories. See New Hampshire Revised Statutes 21:4

(b) The suitability of land as to soil classification and other criteria for agricultural use; and
(c) The fair market value of such land pursuant to N.H. Rev. Stat. § 75:1 as determined by an independent appraisal and the fair market value of such land when used for agricultural purposes which shall be the top of the value range for horticultural crops as established by the current use board. The landowner shall bear the expense of the appraisal of the land to be acquired.
