Terms Used In New Hampshire Revised Statutes 536-A:13

  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • person: may extend and be applied to bodies corporate and politic as well as to individuals. See New Hampshire Revised Statutes 21:9
  • Plaintiff: The person who files the complaint in a civil lawsuit.
  • Writ: A formal written command, issued from the court, requiring the performance of a specific act.
Where a writ of replevin has been issued ex parte and prior to hearing, the defendant or other person from whom possession of such property has been taken may apply to the court for an order shortening the time for hearing on the order to show cause; and the court may, upon such application, shorten the time for such hearing, and direct that the matter shall be heard on not less than forty-eight hours’ notice to the plaintiff.
