  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Personal property: All property that is not real property.
If the defendant shall prevail, he shall have judgment for the return of such personal property or part thereof, if he so elects, as remains in the possession of the applicant and such further damages as may be awarded him.
