Terms Used In New Hampshire Revised Statutes 568:54

  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Probate: Proving a will
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
In case of appeal from the allowance or disallowance of the claims of a creditor, the claimant, if appellant, shall file in the office of the clerk, with his statement of reasons for appeal, a declaration in proper form upon his claim; if appellee, he shall file such declaration within 5 days after notice of the appeal. The clerk shall thereupon file in the office of the clerk of the superior court duly attested copies of the papers relating to the appeal. The case shall be in order for trial at the first term of the court, and the result shall be certified to the court of probate. The proceedings there shall be altered to conform thereto.
