Terms Used In New Jersey Statutes 50:3-15.1

  • person: includes corporations, companies, associations, societies, firms, partnerships and joint stock companies as well as individuals, unless restricted by the context to an individual as distinguished from a corporate entity or specifically restricted to one or some of the above enumerated synonyms and, when used to designate the owner of property which may be the subject of an offense, includes this State, the United States, any other State of the United States as defined infra and any foreign country or government lawfully owning or possessing property within this State.   • State: extends to and includes any State, territory or possession of the United States, the District of Columbia and the Canal Zone. See New Jersey Statutes 1:1-2
3. a. No oysters which measure less than three inches from hinge to mouth shall at any time be taken from the waters in or upon any of the beds, rivers or creeks of this State named in R.S.50:3-14, or be in the possession of any person after being so taken; except that this prohibition shall not apply to spat or blisters adhering so closely as to be impossible to remove without destruction; but in no case shall this exception amount to more than 10% of any catch or cargo; but this minimum size shall not apply to:

(1) Elder point beds, Andrews ditch beds, East point beds, as the same are described in R.S.50:3-14;

(2) Maurice River beds;

(3) Nantuxent beds at the mouth of Nantuxent Creek;

(4) Back Creek beds at the mouth of Back Creek;

(5) Back Creek from the mouth thereof to the south bank of the mouth of Tweed Creek; and

(6) Cohansey beds at the mouth of Cohansey River.

b. This section shall not apply to oysters produced on aquaculture leases.
