Terms Used In New Jersey Statutes 52:17B-107.1

  • Decedent: A deceased person.
  • person: includes corporations, companies, associations, societies, firms, partnerships and joint stock companies as well as individuals, unless restricted by the context to an individual as distinguished from a corporate entity or specifically restricted to one or some of the above enumerated synonyms and, when used to designate the owner of property which may be the subject of an offense, includes this State, the United States, any other State of the United States as defined infra and any foreign country or government lawfully owning or possessing property within this State. 2. Whenever a person‘s death occurs during an encounter with a police officer or other law enforcement officer acting in the officer’s official capacity or while the decedent was in custody, requiring the Attorney General to supersede the county prosecutor of the county in which the incident occurred for the purpose of conducting any investigation, criminal action or proceeding concerning the incident in accordance with paragraph (2) of subsection a. of section 11 of P.L.1970, c.74 (C. 52:17B-107), the identity of each investigating and arresting officer shall remain subject to public disclosure pursuant to the provisions of P.L.1963, c.73 (C. 47:1A-1 et seq.).
