Any party to a proceeding on a writ of habeas corpus may procure the attendance of witnesses at the hearing, by subpoena, to be issued by the clerk of any superior court, under the same rules, regulations and penalties prescribed by law in other cases. Terms Used In North Carolina General Statutes 17-31

  • Habeas corpus: A writ that is usually used to bring a prisoner before the court to determine the legality of his imprisonment. It may also be used to bring a person in custody before the court to give testimony, or to be prosecuted.
  • Subpoena: A command to a witness to appear and give testimony.
  • Writ: A formal written command, issued from the court, requiring the performance of a specific act.
