Terms Used In North Carolina General Statutes 20-219.5

  • following: when used by way of reference to any section of a statute, shall be construed to mean the section next preceding or next following that in which such reference is made; unless when some other section is expressly designated in such reference. See North Carolina General Statutes 12-3

A motor vehicle dealer, as defined in N.C. Gen. Stat. § 20-286(11), and the dealer’s owners, shareholders, officers, employees, and agents who, in conjunction with the actual or potential sale or lease of a motor vehicle, arrange to provide, provide, or otherwise make available to a vehicle purchaser, lessee, or other person any third-party motor vehicle history report, shall not be liable to the vehicle purchaser, lessee, or other person for any errors, omissions, or other inaccuracies contained in the third-party motor vehicle history report that are not based on information provided directly to the preparer of the third-party motor vehicle history report by that dealer. For purposes of this section, a “third-party motor vehicle history report” means any information prepared by a party other than the dealer, relating to any one or more of the following: vehicle ownership or titling history; liens on the vehicle; vehicle service, maintenance, or repair history; vehicle condition; or vehicle accident or collision history.
