Terms Used In North Carolina General Statutes 58-71-25

  • Bail: Security given for the release of a criminal defendant or witness from legal custody (usually in the form of money) to secure his/her appearance on the day and time appointed.
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.

After there has been a breach of the undertaking in a bail bond, the surety may surrender the defendant as provided in N.C. Gen. Stat. § 15A-540 (1963, c. 1225, s. 6; 1975, c. 619, s. 1; 2000-133, s. 7.)
