(1) The Environmental Quality Commission shall adopt by rule criteria for certification of approved retrofit technologies for the retrofit of a diesel engine that powers a medium-duty truck or a heavy-duty truck. In determining the criteria and approved retrofit technologies, the commission shall consider:

(a) Regulations adopted by the State of California for reducing diesel engine emissions from in-use medium-duty trucks and heavy-duty trucks; and

(b) The list of technologies approved as qualifying retrofits included in the standards established by the commission under ORS § 468A.799.

(2) The commission shall prescribe by rule the manner for issuing certification that a diesel engine has been retrofitted with approved retrofit technology in compliance with the criteria adopted by rule under subsection (1) of this section.

(3) When proof of certification that a diesel engine has been retrofitted with approved retrofit technology is required under ORS § 803.591, the proof may be provided by any means that the Department of Transportation and the commission determine by joint rulemaking or by interagency agreement to be satisfactory.
