All fees, taxes and charges imposed by this chapter and ORS Chapter 826, all claims and penalties payable by any person under this chapter and ORS Chapter 826 and all moneys collected under this chapter and ORS Chapter 826, are the property of the state. The Department of Transportation shall collect and receive all fees, taxes, penalties and moneys due or to become due to the state under this chapter and ORS Chapter 826 and, to that end, shall bring such actions or take such proceedings, including attachment and garnishment proceedings, in the name of the State of Oregon, as may be necessary. Terms Used In Oregon Statutes 825.498
- Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.
- Department: means the Department of Transportation. See Oregon Statutes 825.005
- Garnishment: Generally, garnishment is a court proceeding in which a creditor asks a court to order a third party who owes money to the debtor or otherwise holds assets belonging to the debtor to turn over to the creditor any of the debtor
- Person: includes individuals, corporations, associations, firms, partnerships, limited liability companies and joint stock companies. See Oregon Statutes 174.100
