Terms Used In South Carolina Code 44-20-800

  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Applicant: means a person who is believed to have intellectual disability, one or more related disabilities, one or more head injuries, one or more spinal cord injuries, or an infant at high risk of a developmental disability who has applied for services of the South Carolina Department of Disabilities and Special Needs.   • Department: means the South Carolina Department of Disabilities and Special Needs. See South Carolina Code 44-20-30
An applicant or licensee who is dissatisfied with the decision of the department as a result of the hearing provided for by "Procedures Governing Disciplinary Hearings …" may appeal to a South Carolina administrative law judge as provided in Article 5, Chapter 23 of Title 1.
