South Dakota Codified Laws 22-33-9.2. Second degree arson

Any person who starts a fire or causes an explosion with the intent to:

(1) Destroy any unoccupied structure of another; or

Under the South Dakota Laws, punishments for crimes depend on the classification. In the case of this section:

Class	Prison	Fine
Class 4 felony	up to 10 years	up to $20,000

Person: includes natural persons, partnerships, associations, cooperative corporations, limited liability companies, and corporations. See South Dakota Codified Laws 2-14-2
Property: includes property, real and personal. See South Dakota Codified Laws 2-14-2

(2) Destroy or damage any property, whether his or her own or another’s, to collect insurance for such loss;

is guilty of second degree arson. Second degree arson is a Class 4 felony.
